ORDINANCE NO. 040237

 

Approving the preliminary plat of Ponce de Leon Condominiums on an approximately half acre tract of land generally located at the northeast corner of 46th Street and Main Street. (SD 1081)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Ponce de Leon Condominiums on an approximately half acre tract of land generally located at the northeast corner of 46th Street and Main Street, and more specifically described as follows:

 

This is a resurvey and resubdivision of part of Lots 4, 5, 6, 7, 8, 9, Subdivision of Lot 6, Amended Plat of South Moreland, a subdivision of land in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the Southwest corner of said Lot 7, said point being on the East right-of-way line of Main Street, and the North right-of-way line of 46th Street, as said streets are now established; thence N 2E 20' 39" E, along the West line of said Lots 7, 8, 9, and along the East right-of-way line of said Main Street, a distance of 124.40 feet, to a point 14.50 feet South of the Northwest corner of said Lot 9; thence S 87E 25' 26" E, a distance of 175 feet; thence S 2E 20' 39" W, along a line parallel with the East line of said Main Street, a distance of 151.92 feet, to a point on the North line of said 46th Street; thence Northwesterly, along the North line of said 46th Street, said line being a curve to the left having a radius of 851 feet, a central angle of 11E 57' 22" and whose initial tangent bearing is N 72E 30' 52" W, a distance of 177.58 feet measured (177.36 feet platted), to the point of beginning, containing 0.542 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That a variance to the required dedication of ten feet of additional right-of-way for Main Street is hereby granted.

 

3. That the developer receive the approval of the Main Street Special Review District Committee prior to receiving building permits for any modifications to the site or building exterior.

 

4. That the developer submit a detailed storm drainage study to the City Engineers Office prior to approval and issuance of any building permits, that consists at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the


proposed improvements will not alter or increase historical runoff conditions for the site, and that the developer construct any improvements as required by the City Engineers Office.

 

5. That the developer submit covenants, conditions and restrictions to the Law Department prior to the approval of the final plat.

 

6. That the developer secure permits to construct new or reconstruct existing sidewalks, curb and gutters along the project frontage, as required by the Department of Public Works prior to recording of the final plat.

 

7. That the developer obtain permits for encroachments along the E. 46th Street right-of-way prior to recording of the final plat, as required by the City Engineers Office.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 040237, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
