ORDINANCE NO. 071170

 

Approving an amendment to a previously approved GP District development plan on approximately 35 acres generally located west of Interstate 29 and north of N.W. Cookingham Drive in District GP-3. (7893-GP-7).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District GP-3 (Kansas City International Airport General Planned Development District, Regional Business) on approximately 35 acres generally located west of Interstate 29 and north of N.W. Cookingham Drive and more specifically described as follows:

 

All of Lots 2, 3, 4, and 5, Airport America, and all of Lots 1A & 6A Airport America Replat of Lots 1 and 6 both being a subdivision of land in Kansas City Platte County, Missouri, containing 34.84 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

(1)               That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

(2)               That the developer submit plans for grading and siltation and erosion control to the City Development Department, Development Services Division, for approval prior to beginning any construction activities.

 

(3)               That the developer secure a land disturbance permit from the City Development prior to beginning any construction, grading, clearing, or grubbing activities if the disturbed area equals one acre or more.

 

(4)               That the developer submit covenants, conditions, and restrictions to Development Services for review by the Law Department for approval with the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

(5) That the developer update the previously approved macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for review and acceptance prior to clearance of the next plat and make necessary improvements as required by Development Services.

 

(6)               That the developer comply with the Kansas City International Airport Height Zoning restrictions as shown on the final plat.

 

(7)               That the developer enter into a Fair Disclosure Agreement to provide disclosure at the time of any real estate transaction.

 

 

 

 

(8)               That the developer grant an Aviation Noise Easement (for each phase) to the City and file same with each final plat as required by the Aviation Department.

 

(9)               That the developer utilize sound reducing building materials in the construction of any buildings on the site.

 

(10)           That the developer provide for fire protection as required by the Fire Department.

 

(11)           That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming, and signage. Further, the final plan shall portray placement of a steel decorative fence a distance of 400 ft. beyond the northern curb of the parking operations entrance off N.W. Prairie View Road.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
