ORDINANCE NO. 961498

 

Approving the urban renewal plan for an approximately 7.78 acre tract of land generally bounded by Westport Road on the north, 43rd Street on the south, Mill and Washington Streets on the east and Pennsylvania Avenue on the west, subject to certain findings and conditions and to be known as the Westport and Mill Urban Renewal Area; declaring said area to be a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Law.

 

WHEREAS, Section 99.430, Revised Statutes of Missouri, 1994, as amended ("RSMo"), provides that an urban renewal plan may be prepared subject to the declaration that the area is blighted or insanitary and in need of redevelopment and rehabilitation; and

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on August 28, 1996, adopt a resolution approving an urban renewal plan for the area generally bounded by Westport Road on the north, 43rd Street on the south, Mill and Washington Streets on the east and Pennsylvania Avenue on the west to be known as the Westport and Mill Urban Renewal Area; and

 

WHEREAS, said area is blighted due to insanitary or unsafe conditions, deterioration of site improvements and the existence of conditions which endanger life or property by fire or other causes; and

 

WHEREAS, the City Plan Commission has reviewed and recommended approval of the finding of blight and of the urban renewal plan on October 15, 1996, and has found said plan to be in conformance with the Master Plan for the development of the community as a whole as evidenced by its resolution recommending the adoption of said Plan, a copy of which is attached hereto and incorporated herein as Exhibit "A"; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Urban Renewal Plan for the Westport and Mill Urban Renewal Area, more specifically described as follows:

 

All of Lots 6, 7 and 8, John C. Morris Subdivision, Lots 9, 10, 11, 12, 13 and part of Lots 14, 15 and 16, Edmund Prices Addition and vacant streets and alleys adjacent. And more specifically described: Beginning at the southeast corner of Pennsylvania and Westport Road, then southerly along the easterly line of Pennsylvania Street to the northeast corner of 43rd and Pennsylvania (southwest corner of Lot 8, Edmund Prices Addition) then east along said south lot line and extension 235.03 feet then north 110 feet, then east 128 feet to the east lot line of Lot 10 (the west line of Washington Street), then north along west line of Washington Street to the north line of vacated Archibald, then northeasterly to the southeast corner of Lot 7, John C. Morris Subdivision, then northwesterly to the south line of Westport Road, then west along the said line to the point of beginning.

 

is hereby approved, subject to certain findings and conditions. A copy of said Urban Renewal Plan is on file in the office of the City Clerk under Document No. 961498, which is attached hereto and made a part hereof.

 

Section 2. That the area legally described above is a blighted area due to insanitary or unsafe conditions, deterioration of site improvements, and the existence of conditions which endanger life or property by fire or other causes and is in need of redevelopment and rehabilitation.

 

Section 3. That said Urban Renewal Plan is found to be feasible and in conformance with the Master Plan for the development of the community as a whole.

 

Section 4. That this Council has duly made the findings necessary for compliance with Sections 99.320 and 99.430, RSMo 1994.
