ORDINANCE NO. 070467

 

Authorizing the City Manager to execute the Eighth Amendment to the Master Development Agreement with Kansas City Live, LLC, providing for the development of a mixed-use hotel/residential tower in the 1200 Main/South Loop Tax Increment Redevelopment Area and expressing the Councils support of the Downtown Hotel Study as produced by Convention Sports & Leisure and encouraging the new City administration to begin planning now for the downtown convention and visitor business for 2007 and beyond.

 

WHEREAS, the City and Kansas City Live, LLC, (Developer) have entered into a Master Development Agreement dated April 27, 2004, which has been amended by the First Amendment to Development Agreement dated as of July 24, 2004, the Second Amendment to Development Agreement dated as of September 15, 2004, the Third Amendment of Development Agreement dated as of February 7, 2005, the Fourth Amendment of Development Agreement dated as of March 8, 2005, the Fifth Amendment of Development Agreement dated as of March 9, 2005, the Sixth Amendment of Master Development Agreement dated as of May 1, 2006, and the Seventh Amendment of Master Development Agreement dated as of May 1, 2006 (collectively, the Master Development Agreement); and

 

WHEREAS, the City and the Developer have determined that the combination of new construction of residential and new, unique, high-end boutique hotel product (Boutique Hotel) is critical to the success of the 1200 Main/South Loop Tax Increment Financing Plan and the City has determined that a downtown convention center headquarters hotel (Convention Hotel) is critical to the downtown renaissance; and

 

WHEREAS, the City and the Developer desire to amend the Master Development Agreement to provide for the development of the Boutique Hotel; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Manager is hereby authorized to execute the Eighth Amendment to the Master Development Agreement with Kansas City Live, LLC, providing for the development of a Boutique Hotel in the 1200 Main/South Loop Tax Increment Redevelopment Area, and is hereby authorized to take such further action, and execute such other documents, certificates and instruments, including any required agreements or documentation, as may be necessary or desirable to carry out and comply with the intent of this ordinance and to comply with and perform the duties of the City with respect to the Eighth Amendment.


Section 2. That the Mayor and Council embrace the findings of the study conducted by CSL and encourage the new Mayor and Council to immediately begin planning efforts for Kansas Citys additional hotel stock, specifically a Convention Hotel to further expand Kansas Citys Downtown renaissance. The developer of the Convention Hotel will be determined at a later time.
