FOR ORDINANCE NO. 050718
Finding the Stuart Hall/HD Lee
PIEA Planning area, as amended, to be blighted and in need of redevelopment;
approving the First Amendment to the General Development Plan for the Stuart
Hall/HD Lee PIEA Planning Area generally located on the north side of 22nd
Street, between Central and Fort Scott Avenue, extending approximately 335 feet
north, and on the north side of 22nd Street, between Wyandotte and St. Paul
Avenue, extending north to 20th Street. and approving ad valorem tax benefits
therefor.
WHEREAS, the Planned
Industrial Expansion Authority of Kansas City, Missouri, (the Authority)
adopted Resolution No. 823 on December 5, 2003, finding that the area described
herein to be blighted pursuant to PIEA Law and recommending to the City Council
of Kansas City, Missouri that said area be designated as blighted, unsanitary,
or an underdeveloped industrial areas defined by section 100.310 (2), 100.310
(11), and 100.310 (18), RSMo, and
WHEREAS, said area
was declared to be blighted by the City Council through adoption of Resolution
No. 031355 on December 18, 2003; and
WHEREAS, the Council
approved the General Development Plan for the Stuart Hall/HD Lee PIEA Planning
Area on June 3, 2004, by passage of Ordinance No. 040469; and
WHEREAS, on April 29,
2005, the Authority adopted Resolution No. 976, approving the First Amendment
to the Stuart Hall/HD Lee PIEA Planning Area, finding the expanded area to be a
blighted, unsanitary, or an underdeveloped industrial area defined by section
100.310 (2), 100.310 (11), and 100.310 (18), RSMo, and recommending that
the First Amendment be approved;
WHEREAS, the City
Plan Commission has reviewed and recommended approval of the finding of blight
for the area, as amended, and of the First Amendment to the General Development
Plan for the Stuart Hall\HD Lee PIEA Planning Area on June 21, 2005 and has
found said plan to be in conformance with the general plan for the development
of the community as a whole; and
WHEREAS, Section
100.400, RSMo, authorizes the Council to approve a general development plan
after a designation of blight if the Council finds that the plan is feasible
and in conformity with the general plan for the redevelopment of the community
as a whole; and
WHEREAS, the Council
has determined that ad valorem tax exemption benefits as authorized in Section
100.570, RSMo are necessary to attract developers to the expanded area; NOW,
THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That the
Stuart Hall/HD Lee PIEA Planning Area, as amended, is hereby found to be a
blighted, unsanitary or an undeveloped industrial area as defined by Section
100.310, RSMo.
Section 2. That
the First Amendment to the General Development Plan for Stuart Hall/HD Lee PIEA
Planning Area, as shown in the plan and blight analysis dated March 21, 2005
and revised June 28, 2005, generally located on the north side of 22nd Street,
between Central and Fort Scott Avenue, extending approximately 335 feet north,
and on the north side of 22nd Street, between Wyandotte and St. Paul Avenue,
extending north to 20th Street legally described as:
Lots 9 through 19, inclusive,
Block 23, Goodrich Addition, a subdivision of land lying in Kansas City,
Jackson County, Missouri, according to the recorded plat thereof; and
Lots 4 through 14, inclusive,
Block 20, Goodrich Addition, a subdivision of land lying in Kansas City,
Jackson County, Missouri, according to the recorded plat thereof; and
Lots 1, 2, and 3, Block 20 and
all of Block 27, Goodrich Addition, a subdivision of land lying in Kansas City,
Jackson County, Missouri, according to the recorded plat thereof; and also all
that part of the Southwest Quarter of the Northwest Quarter of Section 8,
Township 49, Range 33, described as follows: Beginning 316 feet West of the
Northeast corner of said Southwest Quarter of the Northwest Quarter; thence
running South 212 feet; thence West 158 feet; thence North 212 feet; thence
East 158 feet to the point of beginning; subject to the rights of the public in
the North 30 feet thereof taken for street purposes, in Kansas City, Jackson
County, Missouri, and
All of the street right of way
for 22nd Street between Central and St. Paul Avenue, and
The South 10
feet of Lot 9, All of Lots 10, 11, 12, 13 and 14, Block 21, Goodrich Addition,
A Subdivision in Kansas City, Jackson County, Missouri.
is hereby approved. A copy of
said plan is attached hereto and incorporated herein by reference is Document
No. 050___.
Section 3. That
the Council has duly made the findings necessary for compliance with Section
100.300-100.620 RSMo.
Section 4. That
said First Amendment to the General Development Plan for the Stuart Hall/HD Lee
PIEA Planning Area is hereby found to be feasible and in conformance with the
general plan for the development of the community as a whole.
Section 4. That
the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo,
are hereby extended to the plan area, as amended by the First Amendment, to the
extent and in the manner as provided for in said General Development Plan,
subject to the execution of a development agreement with the Authority.
