ORDINANCE NO. 070896

 

Rezoning an area of approximately 39.4 acres generally bounded by Armour Boulevard on the north, 39th Street on the south, McGee Street on the east and a line midway between Broadway and Central Street on the west from Districts R-4, R-5, C-2 and C-3a2 to Districts R-1b and R-2b. (13802-P)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0770, rezoning an area of approximately 39.4 acres generally bounded by Armour Boulevard on the north, 39th Street on the south, McGee Street on the east and a line midway between Broadway and Central Street on the west from Districts R-4 (Low Apartments), R-5 (High Apartments), C-2 (Local Retail Business) and C-3a2 (Intermediate Business, High Buildings) to Districts R-1b (One-Family Dwellings) and R-2b (Two-Family Dwellings), said section to read as follows:

 

Section 80-11A0770. That an area legally described as:

 

Lots 10 and 11, Block 7, Hyde Park; and

 

Lots 8, 9 and 10, Block 8, Hyde Park; and

 

Lots 4 through 9 inclusive, Block 9, Hyde Park; and

 

Lots 1, 2, 3, 5 and 6, Hanover Place and the east of the vacated alley lying west of and adjacent said lots, and Lots 8, 9, the south 37 feet of Lot 10, the north 13 feet of Lot 11, and Lot 12, Hanover Place and the west of the vacated alley lying east of and adjacent said lots; and Lots 1 through 14 inclusive, Block 59, Hyde Park; and

 

The north 35 feet of Lot 20, and Lots 21 through 24 inclusive, Block 29, Hyde Park, and Lot 2, Lots 5 through 10 inclusive and Lot 12, Block 2, Hyde Park Annex; and

Lots 3 through 6 inclusive, Block 41, Hyde Park; and Lot 1, and the north of Lot 2, and Lot 4, Arnolds Resurvey of T. C. Crosss Addition to Westport; and

 

Lots 2 through 8 inclusive, Block 40, and Lots 1 through 3 inclusive and Lots 10 through 12 inclusive, Block 43, and the west 112 feet and the south 5 feet of the east 20.58 feet of Lot 2, Block 49, Hyde Park; and

 

Lots 7 and 8, Block 39, and the north 83.42 feet of the west 15 feet of Lot 1, and Lot 2, Block 50, Hyde Park; and

 

Lots 7 through 13 inclusive, Block 18, Hyde Park; and

 

Lots 7 through 13 inclusive except that portion in right of way, and Lots 14 through 19 inclusive, and the south 25 feet of Lot 20, Block 17, Hyde Park; and

 

Lots 1 through 7 inclusive, and the south 5 feet of Lot 8, and Lots 9 through 12 inclusive, Block 19, Hyde Park; and

 

Lots 1 and 2 except that portion in right of way, and Lots 17 and 18, and Lots 20 through 24 inclusive, Block 20, Hyde Park; and

 

Lots 5, 6 and 7, and the north 15 feet of Lot 16, and Lots 17 and 18 except that portion in right of way, Block 21, Hyde Park; and

 

Lots 1 through 12 inclusive, Block 34, Hyde Park; and

 

Lots 6, 7, 8, and the north 38 feet of Lot 9 except that portion in right of way, and Lots 13 through 24 inclusive, Block 33, Hyde Park; and

 

Lots 1 through 12 inclusive, and Lots 16 through 24 inclusive except that portion in right of way, Block 32, Hyde Park; and

 

Lots 1, 2 and 3, Block 35, Hyde Park, and Lots 1 through 4 inclusive, Block 52, Hyde Park; and

 

Lots 3 through 6 inclusive except that portion in right of way, and Lots 7, 8, 11 and 12, Block 36, Hyde Park, and Lots 2 through 4 inclusive except that portion in right of way, and Lots 9 through 12 inclusive, Block 51, Hyde Park

 

is hereby rezoned from District R-4 (Low Apartments) to District R-1b (One-Family Dwellings); and

 

Lot 3, Block 9, Hyde Park

 

is hereby rezoned from District R-5 (High Apartments) to District R-1b (One-Family Dwellings); and

 

The east 24.6 feet of Lots 17 and 18, Block 18, Hyde Park, and Lot 9, Block 43, Hyde Park

 

is hereby rezoned from District C-2 (Local Retail Business) to District R-1b (One-Family Dwellings); and

 

Lot 4, Block 43, Hyde Park

 

is hereby rezoned from District C-3a2 (Intermediate Business, High Buildings) to District R-1b (One-Family Dwellings); and

 

Lot 7, Hanover Place and the west of the vacated alley lying east of and adjacent said lot; and

 

Lot 4 Hanover Place and the east of the vacated alley lying west of and adjacent said lot; and

 

Lot 11, Block 2, Hyde Park Annex; and

 

The north 45 feet of Lot 8, Block 19, Hyde Park; and

 

All Lot 19, Block 20, Hyde Park; and

 

The south 49 feet of the west 82 feet of Lot 15, and the south 47 feet of the east 47.05 feet of Lot 15, and Lots 22 and 23, Block 23, Hyde Park

 

is hereby rezoned from District R-4 (Low Apartments) to District R-2b (Two-Family Dwellings), all in Kansas City, Jackson County, Missouri, all as shown outlined on a map marked Section 80-11A0770, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
