ORDINANCE NO. 971757

 

Accepting various easements in Clay and Platte Counties; releasing various easements in Jackson and Clay Counties; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements in Kansas City, Clay County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

Section 2. That various easements in Kansas City, Platte County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

2. Temporary Easement from Tiffany Greens, Inc., Instrument No. 0016321, book 872, page 579;

 

3. Storm Drainage Easement from Larry G. Hurshman and Jeannette E. Hurshman, Instrument No. 0016322, book 872, page 580;

 

4. Temporary Easement from VVSB Service Corp., Instrument No. 0016323, book 872, page 581;

all recorded in the office of the Recorder of Deeds for Platte County, Missouri, at Platte City, are hereby accepted.

 

Section 3. That the legal descriptions for such properties listed in Sections 1 and 2 are set forth in Exhibit A, which is attached hereto and incorporated herein by reference.

 

Section 4. That the 15.00 foot wide utility easement lying across the West 15.00 feet of Lot 1, "Mackey's West Subdivision;" and the 10.00 foot wide water main easement lying across the East 10.00 feet of said Lot 1 and across the East 10.00 of the South 5.00 feet of Lot 2, said subdivision; and the 10.00 foot wide sanitary sewer easement lying across the West 10.00 feet of the East 20.00 feet of said Lot 1, all being dedicated by the plat of "Mackey's West Subdivision," a subdivision in Kansas City, Jackson County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 5. That all of the public easement reserved by Ordinance No. 970192 passed on March 20, 1997, lying in the vacated alley way next East of Locust Street from the South line of 9th Street to the North line of 10th Street all in Section 5-49-33 in Kansas City, Jackson County, Missouri, except for that portion of the public easement reserved by Ordinance No. 970192 beginning at the North line of 10th Street and ending at the Westerly extension of the line that is 12 feet South of the North line of Lot 26, Block 15 "Smart's Addition No 3," a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, and except for the Westerly half of that portion of the public easement reserved by Ordinance No. 970192 beginning at the Westerly extension of the line that is 12 feet South of the North line of Lot 26, Block 15, "Smart's Addition No 3," a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof and ending at the Easterly extension of the North line of Lot 3, Block 4, "Smart's Subdivision," also known as "Smart's Second Addition," a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 6. That the temporary grading easement previously recorded at the Office of the Recorder of Deeds for Clay County, Missouri, as Document No. M90876 in Book 2538, at Page 337; a tract of land in the Southeast Quarter of Section 15, Township 51, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Southeast corner of said Southeast Quarter; thence North 88 48'09" West, along the South line of said Southeast Quarter, 945.68 feet; thence North 01 11'51" East, 459.11 feet to the True Point of Beginning of the tract to be herein described; thence North 63 32'16" West, 50.00 feet; thence North 26 27'44" East, 199.75 feet; thence South 63 32'16" East, 50.00 feet; thence South 26 27'44" West, 199.75 feet to the True Point of Beginning, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

That the standard sewer easement previously recorded at the Office of the Recorder of Deeds for Clay County, Missouri, as Document No. M99447 in Book 2562 at Page 424; a strip of land 10.00 feet wide in the Southeast Quarter of Section 15, Township 51, Range 32, Kansas City, Clay County, Missouri, lying 05.00 feet on each side of the following described centerline: Commencing at the Southeast corner of said Southeast Quarter; thence North 88 48'09" West, 1,019.02 feet; thence North 01 11'51" East, 420.86 feet to the True Point of Beginning of said centerline; thence North 54 37'07" West, 13.88 feet to the Point of Termination, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 11. That the standard sewer easement previously recorded at the Office of the Recorder of Deeds for Clay County, Missouri, as Document No. M90879 in Book 2538 at Page 343; a strip of land 10.00 feet wide in the Southeast Quarter of Section 15, Township 51, Rand 32, Kansas City, Clay County, Missouri, lying 05.00 feet on each side of the following described centerline: Commencing at the Southeast corner of said Southeast Quarter; thence North 88 48'09" West, 1,026.62 feet; thence North 01 11'51" East, 404.77 feet to the True Point of Beginning of said centerline; thence North 73 58'59" West, 13.64 feet to the Point of Termination, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 12. That the storm drainage easement previously recorded at the Office of the Recorder of Deeds for Clay County, Missouri, as Document No. E33455 in Book 1448 at Page 698; a tract of land lying in the Northeast Quarter of Section 10, Township 50, Range 32, Kansas City, Clay County, Missouri, described as follows: Beginning at a point on the East line of "Great Midwest Industrial Park District II," a subdivision of land in said Kansas City, Missouri, said point being on the Easterly prolongation of the centerline of Northeast 38th Street as now established; thence South 00 58'01" East along the East line of said plat a distance of 85.03 feet to the True Point of Beginning; thence North 00 58'01" West, 13.00 feet to a point of curve tangent to the last described course, having a radius of 41.00 feet; thence Northeasterly along said curve to the right, 65.41 feet to a point of tangency; thence South 89 33'30" East, 08.00 feet; thence South 41 56'41" West, 73.45 feet to the True Point of Beginning, (bearings referenced to said plat), be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 13. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the offices of the Recorder of Deeds for Jackson County, Missouri, at Kansas City, Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City, respectively.
