ORDINANCE NO. 040736

 

Approving the preliminary plat of Cadillac Condominium on approximately a 0.66 acre tract of land generally located on the south side of 29th Street between McGee Trafficway and Gillham Road. (SD 1093)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Cadillac Condominium on approximately a 0.66 acre tract of land generally located on the south side of 29th Street between McGee Trafficway and Gillham Road, and more specifically described as follows:

 

Lots 1 thru 12, inclusive, lying East of and Northeasterly of McGee Trafficway, except this part taken by Gillham Road, Block 4, Coleman Place, a subdivision of land in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineering stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to the City Engineers Office prior to approval and issuance of any building permits, and that the developer construct any improvements as required by the City Engineer's Office.

 

3. That a 37.5 foot variance to the minimum required right of way width of 75 feet, as measured from the centerline, for a parkway/boulevard be granted, so as to permit 37.5 feet of right of way from the centerline of Gillham Road, as shown on the preliminary plat.

 

4. That a 6 foot variance to the minimum required right of way width, as measured from the centerline of 29th Street, to permit a final total of 25 feet of right of way from the centerline of 29th Street, as shown on the preliminary plat, is hereby granted.

 

5. That a 6 foot variance to the minimum required right of way width, as measured from the centerline of McGee Trafficway, to permit a final total of 40 feet of right of way from the centerline of McGee Trafficway, as shown on the preliminary plat, is hereby granted.

 


6. That the developer secure permits to reconstruct, as necessary, sidewalks, curb and gutter, storm sewers and streetlights along all development street frontages as required by the Department of Public Works, prior to the recording of the final plat.

 

7. That the developer obtain and record a permanent encroachment for the west side of the property as required by the Department of Public Works, or vacate the right of way at these locations, prior to the recording of the final plat.

 

8. That the developer relocate streetlights so that they are integrated into the existing street lighting system as required by the City Engineers Office.

 

9. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

10. That the developer submit covenants, conditions and restrictions to the Law Department for approval with the final plat for the maintenance of private open space and any detention area tracts.

 

11. That the developer provide for fire protection as required by the Fire Department.

 

12. That the developer contribute $4,450.68 in lieu of parkland dedication for 29 units (29 x 2 x 0.006 x $12,789.30) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 040736, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
