COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 110022

 

Approving an amendment to a development plan on about 5.78 acres generally located on the east side of N. Antioch Road between I-35 and N.E. 43rd Street in District CP-2 (Local Planned Business Center), to allow for automobile sales or continued use of the existing convenience store, and to allow the existing motel and restaurant uses to remain. (4817-CP-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan on about 5.78 acres generally located on the east side of N. Antioch Road between I-35 and N.E. 43rd Street in District CP-2 (Local Planned Business Center), to allow for automobile sales or continued use of the existing convenience store, and to allow the existing motel and restaurant uses to remain, and more specifically described as follows:

 

A part of Lots 4 and 5 in Midland Heights, an addition of land in Kansas City, Clay County, Missouri, according to the recorded plat thereof, being more particularly described as follows: Beginning at a point on the South line of Lot 5, Midland Heights, said point being 609.70 feet West of the Southeast corner of said Lot 5; thence South 89 degrees 25 minutes 30 seconds West., along the South line of Lot 5, 150.00 feet to a point on the East right-of-way line of Antioch Road (State Rout #1-TR);Thence North 0 degrees 48 minutes West, along said East right-of-way line, 146.43 feet; thence 12 degrees 42 minutes 49 seconds East, along said right-of-way 9.11 feet to a point on the North line of said Lot 5; thence North 89 degrees 25 minutes 30 seconds East, along the North line of lot 5, 7.87 feet; thence North 0 degrees 48 minutes West, along said East right-of-way line, 32.78 feet; thence North 12 degrees 42 minutes 49 seconds East, along said right-of-way line, 64.17 fee; thence North 32 degrees 43 minutes 38 seconds East, along said right-of –way line 63.37 feet to a point that is 70 feet South of the North line of lot 4, Midland Heights and 100 feet East of the center line of Antioch Road; thence North 89 degrees 25 minutes 30 seconds East, parallel with the North line of said Lot 4, 40.00 feet; thence South 15 degrees 03 minutes 30 seconds East, 100.00 feet; thence North 74 degrees 56 minutes 30 seconds East, at right angles to the last described course, 6.00 feet; thence South 15 degrees 03 minutes 30 seconds East, 177.60 feet; thence South 74 degrees 56 minutes 30 seconds West, 24.83 feet; thence South 0 degrees 34 minutes 30 seconds East 30,00 feet to the Point of Beginning. Being a portion of property conveyed by Special Warranty Deed recorded in Deed Book 1113, Page 237 and dated December 20th , in 1972.

is hereby approved, subject to the following conditions:

 

1.                  That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed development offers no site improvements and, therefore, will not alter or increase historical runoff conditions for the site, to Development Services prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services prior to the issuance of any certificate of occupancy.

 

2.                  That the developer submit a letter from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The letter must identify state of repair as defined in Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to issuance of any certificate of occupancy.

 

3.                  That the developer submit a final plan to the City Plan Commission for approval, indicating plans for landscaping, grading, signage, building elevations, lighting and a photometric study showing zero footcandles at the property lines.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
