COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 130779

 

Declaring certain real property in Beacon Hill along Vine Street surplus to the City=s needs; authorizing the Director of the General Services Department to convey these surplus parcels to the Land Clearance for Redevelopment Authority and further authorizing the execution of related documents.

 

WHEREAS, the City Manager has determined on behalf of all City departments that all parcels of real property owned by, or to be acquired by, the City within the boundaries of the Beacon Hill project area are considered in excess of the needs of the City and no interest has been expressed by any City Department in retaining such parcels for public use; and

 

WHEREAS, these properties in the Beacon Hill project area have been identified for redevelopment by the City Manager and thus are surplus to the City=s needs; and

WHEREAS, on April 28, 2011, the City Council passed Second Committee Substitute for Ordinance No. 110300, authorizing the City Manager to enter into a contract with the Economic Development Corporation of Kansas City, the Land Clearance for Redevelopment Authority of Kansas City, the Economic Development Corporation Charitable Fund and the EDC Loan Corporation for the management of assets to be transferred from the Housing and Economic Development Financial Corporation and the City, in part, for the continued development of the Beacon Hill project; and

WHEREAS, all of the tracts listed below are within the Beacon Hill project area and the Hospital Hill II Urban Renewal Area; and

WHEREAS, the City will direct the Land Clearance for Redevelopment Authority to convey the tracts listed below in furtherance of the continued development of the Beacon Hill project area and the elimination of blight within the Beacon Hill project area; and

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri is a public body corporate and politic duly organized and existing pursuant to Section 99.330, RSMo. having among its powers the redevelopment of blighted areas and the power of eminent domain; and 

 

WHEREAS, the parcels of real property set out below are situated within the Hospital Hill II Urban Renewal Area within which the Land Clearance for Redevelopment Authority of Kansas City, Missouri has the power of eminent domain; and 

 


WHEREAS; Section 99.580, RSMo., of the Land Clearance for Redevelopment Authority Law provides, in pertinent part, that: AFor the purpose of aiding and cooperating in the planning, undertaking or carrying out of a land clearance project located within the area in which it is authorized to act, any public body may, upon such terms, with reasonable consideration, as it may determine: (1) Dedicate, sell, convey or lease any of its interest in any property, or grant easements, licenses or any other rights or privileges therein to an authority . . . .@ and the City is such a Apublic body; and NOW, THEREFORE;

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds and determines that the properties, whose Jackson County property tax parcel identification numbers, legal descriptions and common street addresses, and are set out below, are surplus to the City=s needs:

 

Tract 1. Parcel No. 29-630-29-08

 

All that part of the Southeast quarter of the Southwest quarter of Section 9, Township 49, Range 33 in Kansas City, Jackson County, Missouri described as follows: Beginning on the East line of Vine Street, 10 feet East of the Southwest corner of Lot 10, Block 2, in Shepard & Barndollar’s Addition; thence South 25 feet; thence East 121 feet; thence North 25 feet; thence West 121 feet to beginning, except any part thereof in roads. Commonly known as 2617-19 Vine Street, Kansas City, Missouri.

 

Tract 2. Parcel No. 29-630-29-07

 

Lot 10, except that part in Vine Street, Block 2, Shepard and Barndollar’s Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof. Commonly known as 2615 Vine Street, Kansas City, Missouri.

 

Tract 3. Parcel No. 29-630-29-10

 

Beginning on the East line of Vine Street, 50 feet South of the Southwest corner of Lot 10, Block 2, Shepard & Barndollar’s Addition, thence East 121 feet; thence South 25 feet; thence West 121 feet; thence North 25 feet to beginning, being a part of the Southeast quarter of the Southwest quarter of Section 9, Township 49, Range 33 in Kansas City, Jackson County, Missouri, except any part thereof in roads. Commonly known as 2623 Vine Street, Kansas City, Missouri.

 


Tract 4. Parcel No. 29-630-29-12

 

Part of the Southeast quarter of the Southwest quarter of Section 9, Township 49, Range 33, beginning on the East line of Vine Street, 234 feet North of the North line of 27th Street, thence North 28.5 feet, thence East 121 feet [previously deeded as one hundred one hundred twenty-one feet], thence South 28.5 feet, thence West 121 feet to beginning, in Kansas City, Jackson County, Missouri, except any part in roads. Commonly known as 2627 Vine Street, Kansas City, Missouri.

 

Tract 5. Parcel No. 29-630-29-13

Part of the Southeast quarter of the Southwest quarter of Section 9, Township 49, Range 33, described as follows: Beginning on the East line of Vine Street, in Kansas City, Missouri, 209 feet North of the North line of 27th Street, running thence East and parallel with 27th Street 127 feet to an alley, thence North and parallel with said Vine Street 25 feet, thence West 127 feet to East line of Vine Street, thence South and along said East line of Vine Street 25 feet to place of beginning, except any part thereof in roads. Commonly known as 2629 Vine Street, Kansas City, Missouri.

Tract 6. Parcel No. 29-630-29-14

 

Part of the Southeast quarter of the Southwest quarter of Section 9, Township 49, Range 33, beginning on the East line of Vine Street 182.5 feet North of the North line of 27th Street, thence North 26.5 feet, thence East 121 feet, thence South 26.5 feet, thence West 121 feet to beginning, in Kansas City, Jackson County, Missouri, except any part thereof in roads. Commonly known as 2631 Vine Street, Kansas City, Missouri.

 

Tract 7. Parcel No. 29-630-29-17

 

Part of Section 9, Township 49, Range 33 described as follows: Beginning on the East line of Vine Street 102 feet North of the Northeast corner of 27th Street & Vine, thence East 121 feet, thence North 27.5 feet, thence West 121 feet, thence South 27.5 feet to the point of beginning, in Kansas City, Jackson County, Missouri, except any part thereof in roads. Commonly known as 2637 Vine Street, in Kansas City, Missouri.

 

Section 2. That the Council determines that, if there is any inconsistency or ambiguity between a legal description and a corresponding property tax parcel identification number or common street address set out above, the legal description shall control.

 


Section 3. That the Director of the General Services Department is hereby authorized to transfer each of the properties listed above to the Land Clearance for Redevelopment Authority for the above-described purposes and said Director is further authorized to execute any real estate or other document needed to effectuate the transactions noted herein.
