ORDINANCE NO. 010156
Approving
a $37,904.54 contract with A.D. Jacobson Co. for Contract No. 748 emergency
repair of the influent line at the Todd Creek Wastewater Treatment Plant;
authorizing expenditure of funds therefor; and recognizing an emergency.
WHEREAS,
a 14-inch diameter cast iron discharge line at the Todd Creek Wastewater
Treatment Plant failed and the pump station flooded; and
WHEREAS,
until repairs are completed, it is necessary for the Water Services Department
to pump the effluent flow from the Treatment Plant using a portable pump; and
WHEREAS,
prompt repairs are needed to avoid a potential discharge of untreated
wastewater to waters of the state, in violation of the state permit; and
WHEREAS,
this condition presents an immediate threat to the public health and safety;
NOW, THEREFORE,
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. That a $37,904.54 contract between Kansas City, Missouri, through its
Director of Water Services, and A.D. Jacobson Co. for the emergency repair of a
14 inch discharge line at the Todd Creek Wastewater Treatment Plant is hereby
approved and confirmed. A copy of the contract is on file in the office of the
Director of Water Services.
Section
2. That the Director of Water Services is hereby authorized to expend up to
the sum of $37,904.54 from funds previously appropriated to Account No.
01-811-080-7726-T Sewer Construction to satisfy the cost of this contract.
Section
3. This ordinance is declared to be an emergency measure within the provisions
of Section 15, Article II of the Charter of Kansas City because it is for the
immediate preservation of public property, health and safety and shall take
effect in accordance with that section.

hereby certify that there is a balance, otherwise unencumbered, to the credit
of the appropriation to which the foregoing expenditure is to be charged, and a
cash balance, otherwise unencumbered, in the treasury, to the credit of the
fund from which payment is to be made, each sufficient to meet the obligation
hereby incurred.
