ORDINANCE NO. 980759

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 10.52 acre tract of land generally located on the south side of N.E. 94th Street, east of N. Oak Trafficway. (9468-CP-18)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 10.52 acre tract of land generally located on the south side of N.E. 94th Street, east of N. Oak Trafficway, and more specifically described as follows:

 

All that part of the South One-Half of the Northeast Quarter, Section 2, Township 51, Range 33, Kansas City, Clay County, Missouri, being bounded and described as follows: commencing at the southeast corner of the Northeast Quarter of said Section 2; thence North 8843'13" West, along the south line of said Northeast Quarter, 2453.98 feet; thence North 016'47" East, 350.57 feet to a point on the northerly line of Missouri Route 152, as now established, said point being also the true point of beginning of the tract to be herein described, said point also being a point on the easterly right of way line of N. Oak Street Trafficway, as now established; thence North 835'45" West, along said easterly line, 609.39 feet; thence North 009'08" East, along said easterly line, 216.74 feet; thence northeasterly and easterly, along said easterly line, on a curve to the right, tangent to the last described course, having a radius of 15.00 feet, an arc distance of 23.63 feet to a point on the south right of way line of N.E. 94th Street, as now established; thence South 8935'31" East, along said south line, 613.99 feet to a point on the west line of Oak Hill Estates - First Plat, a subdivision of land in Kansas City, Clay County, Missouri; thence South 555'35" West, along said west line, 866.75 feet to a point on the aforementioned northerly line of said Missouri Route 152; thence North 7127'14" West, along said northerly line, 174.06 feet; thence South 8520'51" West, along said northerly line, 285.00 feet to the true point of beginning. Containing 10.52 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer provide cross-access easements with each final plat as required by the Department of Public Works.

 

6. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

7. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

8. That the developer construct sidewalks on the east side of N. Oak Trafficway as required by the Department of Public Works.

 

9. That the developer submit a final plan for each phase to the City Plan Commission for approval, including plans for landscaping and signage (with elevations).

 


A copy of said amendment is on file in the office of the City Clerk under Document No. 980759, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
