Approving an amendment to a previously approved Community
Unit Project on approximately a 14.09 acre tract of land generally located on
the north side of N.E. Parvin Road, between Searcy Creek Parkway and N.
Bennington Avenue. (6017-CUP-6)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved Community Unit Project on approximately a 14.09 acre tract of land
generally located on the north side of N.E. Parvin Road, between Searcy Creek
Parkway and N. Bennington Avenue, and more specifically described as follows:
All that part of the West Half of the Southeast
Quarter of Section 4, and the East Half of the Southeast Quarter of
Section 5, both being in Township 50, Range 32, Kansas City, Clay County,
Missouri, described as follows: Beginning at the northwest corner of the
Southwest Quarter of the Southwest Quarter of said Section 4; thence North
0 37'56" East along the west line of said Section 4, 106.66 feet to the
true point of beginning; thence South 89 24'41" East, 160.00 feet;
thence North 69 02'51" East, 390.09 feet; thence South 89 24'41"
East, 429.80 feet; thence South 50 13'02" East, 327.50 feet to the
north line of N.E. Parvin Road as now established; thence South 66
02'05" West along said north line, 1234.07 feet to a point of curve, said
curve having a radius of 2814.79 feet; thence along said curve to the
right, 92.47 feet to the west line of said Section 4; thence North 0
37'56" East, along said west line, 162.52 feet; thence North 89
22'30" West, 240 feet; thence North 0 37'56" East, 444.56 feet;
thence South 89 22'30" East, 240.00 feet to the west line of said Section
4; thence North 0 37'56" East, 6.39 feet to the true point of
beginning, except that part in road.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval when the first plat is submitted and that
improvements be made as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer obtain a floodplain
certificate if any grading is to occur within a floodplain.
5. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
6. That the developer extend water mains as
required by the Water Services Department.
7. That the developer provide fire protection as
required by the Fire Department.
8. That the developer submit covenants, conditions
and restrictions to the Law Department for approval.
9. That the developer construct one lane of
adjacent Searcy Creek Parkway to parkway standards.
10. That the developer improve the north half of
N.E. Parvin Road to primary arterial street standards.
11. That the developer contribute $20,110.85 in
lieu of parkland dedication for 200 multi-family units in satisfaction of
Section 66-128 of the Subdivision Regulations.
12. That the developer receive the approval of the
Board of Zoning Adjustment for any signage.
13. That the developer submit a final plan to the
City Plan Commission for approval, including a landscaping plan
consisting of berms, trees, and plantings around and
within the parking lots.
A copy of said Community Unit Project amendment is on
file in the office of the City Clerk under Document No. 960509, which is
attached hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
