ORDINANCE NO. 020224

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0401, rezoning an area of approximately 24.46 acres generally located approximately 300 feet south of 23rd Street and on the west side of Blue Ridge Boulevard (2400 Blue Ridge Boulevard) from Districts PD/M-2a (Planned District/Heavy Industry) and M-2a (Heavy Industry) to District PD/M-2a (Planned District/Heavy Industry), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0401, rezoning an area of approximately 24.46 acres generally located approximately 300 feet south of 23rd Street and on the west side of Blue Ridge Boulevard (2400 Blue Ridge Boulevard) from Districts PD/M-2a (Planned District/Heavy Industry) and M-2a (Heavy Industry) to District PD/M-2a (Planned District/Heavy Industry), said section to read as follows:

 

Section 80-11A0401. That an area legally described as:

 

All that part of the Northeast Quarter of the Southwest Quarter and the Southeast Quarter of the Southwest Quarter of Section 8, Township 49 North, Range 32 West, lying west of the centerline of Blue Ridge Road as same is now established, all in Kansas City, Jackson County, Missouri, more fully described as follows: Beginning at the southwest corner of the northeast of the Southwest Quarter of Section 8, Township 49 North, Range 32 West; thence North 01E43'37" East along the west line of the Northeast Quarter of the Southwest Quarter of said Section 8, a distance of 800.47 feet; thence South 86E53'43" East, a distance of 865.88 feet to the southeast corner of Lot 1, Ridge View Heights, a subdivision in Kansas City, Jackson County, Missouri, said point also being on the west right of way line of Blue Ridge Boulevard, as now established; thence South 05E14'38" East along said west right of way line a distance of 1018.03 feet to a point of curved; thence in a southeasterly direction along a curve to the right having a radius of 2824.9 feet and being tangent to last described course, an arc distance of 131.85 feet to a point on the south line of Lot 1, Subdivision of Fogel Estate; thence North 86E57'38" West along said south line a distance of 1002.39 feet to a point on the west line of the Southeast Quarter of the Southwest Quarter of said Section 8; thence North 01E43'37" East along the west line of the Southeast Quarter of the Southwest Quarter of said Section 8, a distance of 339.10 feet to the point of beginning. Containing 24.457 acres. All bearings are based on Station JA-73 of the Kansas City Metro Control Project, Jackson County, Missouri, as having a grid bearing of South 56E31'06" East between Station JA-73 and JA-73A.

 


is hereby rezoned from Districts PD/M-2a (Planned District/Heavy Industry) and M-2a (Heavy Industry) to District PD/M-2a (Planned District/Heavy Industry), all as shown outlined on a map marked Section 80-11A0401, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer enter into a deferral agreement with the City as required by the Department of Public Works whereby the developer agrees to improve the west half of Blue Ridge Boulevard to secondary arterial street standards, including construction of curb, gutter and sidewalks and installation of streetlights, at such time as Blue Ridge Boulevard is improved immediately adjacent to the north or south.

 

9. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, signage and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 020224, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
