ORDINANCE NO. 041081
Approving
the 25th and Southwest Boulevard (PIEA) General Development Plan for an area of
approximately 3.1 acres generally bounded by Southwest Boulevard and 25th
Street on the north, Belleview Avenue on the east, 26th Street on the south and
a City alleyway just east of Southwest Boulevard and Southwest Boulevard on the
west; declaring the area included in such plan to be a blighted, unsanitary or
undeveloped industrial area and its redevelopment necessary.
WHEREAS,
the Planned Industrial Expansion Authority of Kansas City, Missouri did prepare
or cause to be prepared the 25th and Southwest Boulevard (PIEA) General
Development Plan and recommended that the Council approve the finding of blight
and approve the General Development Plan for the area; and
WHEREAS,
the City Plan Commission has reviewed and recommended approval of the finding
of blight and of the 25th and Southwest Boulevard (PIEA) General Development
Plan on September 7, 2004, as evidenced by its resolution and has found said
plan to be conformance with the general plan for the development of the
community as a whole, a copy of which resolution is attached hereto and
incorporated herein by reference as Exhibit "A"; and
WHEREAS,
Section 100.400, RSMo, authorizes the Council to approve a general development
plan and a designation of blight if the Council finds that the plan is feasible
and in conformity with the general plan for the development of the community as
a whole; NOW, THEREFORE,
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. That the Council declares the area of approximately 3.1 acres generally
bounded by Southwest Boulevard and 25th Street on the north, Belleview Avenue
on the east, 26th Street on the south and a City alleyway just east of
Southwest Boulevard and Southwest Boulevard on the west, and more specifically
described by tax parcel as follows:
2520 Belleview: Lots 1, 2, 3, 4 and 5, Block 4, Gates
Addition, a subdivision in Kansas City, Jackson County, Missouri, according to
the recorded plat thereof.
2524 Belleview and 2530 Belleview: Lots 6, 7, 8, 9 and
10, Block 4, Gates Addition, a subdivision in Kansas City, Jackson County,
Missouri, according to the recorded plat thereof, except that part of Lots 6,
7, 8 and 9 deeded to the Frisco Railway for railroad right-of-way.
2536 Belleview: Lots 11 and 12, Block 4, Gates
Addition, a subdivision in Kansas City, Jackson County, Missouri, according to
the recorded plat thereof.
2536 Belleview: Lot 13, Block 4, Gates Addition, a
subdivision in Kansas City, Jackson County, Missouri, according to the recorded
plat thereof.
2540 Belleview: Lots 14 and 15, Block 4, Gates
Addition, a subdivision in Kansas City, Jackson County, Missouri, according to
the recorded plat thereof.
2542 Belleview: Lot 16, Block 4, Gates Addition, a
subdivision in Kansas City, Jackson County, Missouri, according to the recorded
plat thereof.
2544 Belleview: Lot 17, Block 4, Gates Addition, a
subdivision in Kansas City,
Jackson County, Missouri, according to the recorded
plat thereof.
1000 W. 26th Street: Lots 18, 19 and 20, Block 4,
Gates Addition, a subdivision in Kansas City, Jackson County, Missouri,
according to the recorded plat thereof.
1020 W. 26th Street: All of Lots 21, 22, 23, 24, 25
and 26, and all that part of Lots 27, 28, 29, 30, 31 and 32, Block 4, Gates
Addition, a subdivision in Kansas City, Jackson County, Missouri, as described
as follows: Beginning at the southeast corner of Lot 27, Block 4, of said
addition; thence west along the south line of said Lot 27, a distance of 119.63
feet (Deed 120.26) to the southwest corner thereof; thence northeasterly along
the westerly line of Lots 27, 28 and 29, a distance of 72.55 feet (Deed 75.41
feet); thence southeasterly at right angles to the westerly line of said lot a
distance of 1.50 feet; thence northeasterly on a curve to the right having a
radius of 330.4 feet and tangent to a line at right angles to the last described
course, a distance of 55.08 feet (Deed 54.98 feet); thence continuing in a
northeasterly direction on a curve to the right having a common tangent with
the last described curve and a radius of 311.1 feet, a distance of 61.52 feet
(Deed 60.79 feet), to a point in the east line of said Lot 32, said Block 4,
which is 145.90 feet (Deed 148.07 feet) north of the point of beginning; thence
south 145.90 feet (Deed 148.07 feet) to the beginning, and all that part of
vacated alley lying west of the east line of Lot 23 extending north.
2530 Jarboe: That part of Lot 32, Block 4, Gates
Addition, a subdivision in Kansas City, Jackson County, Missouri, according to
the recorded plat thereof, described as follows: Beginning at the most
northerly corner of said lot; thence southwesterly along the westerly line
thereof to the intersection with the northerly line of the strip conveyed to
the Kansas City Fort Scott and Memphis Railway Company, by the deed recorded as
Document No. A-20026 in Book B-2157 at page 377; thence northeasterly along
said northerly line of to its intersection with the east line of Lot 32; thence
north along the east line of Lot 32 to the point of beginning.
2501 Southwest Boulevard: Lots 33, 34, 35, 36, 37 and
38 and all that part of vacated Southwest Boulevard lying northwesterly of and
adjoining said lots, and included between the side lines of said lots extended
northwesterly, except the southwesterly 24.60 feet of said Lot 38 and of said
part of vacated Southwest Boulevard, Block 4, Gates Addition, a subdivision in
Kansas City, Jackson County, Missouri, according to the recorded plat thereof.
2521 Southwest Boulevard and 2525 Southwest Boulevard:
The southwesterly 24.6 feet of Lot 38 and all of Lots 39, 40, 41, 42, 43, 44,
45, 46, 47 and the vacated portion of Southwest Boulevard lying northwesterly
of and adjoining said lots; Block 4, Gates Addition, a subdivision in Kansas
City, Jackson County, Missouri, according to the recorded plat thereof.
to
be a blighted, unsanitary or undeveloped industrial area in need of industrial
development as defined in Section 100.310, RSMo, which constitutes an economic
or social liability or a serious and growing menace, which is injurious to the
public health, safety, morals, economy and welfare of the residents of Kansas
City, and finds that the elimination or prevention of the detrimental
conditions in such area by the commercial development of such area is necessary
and in the interest of the public health, safety, morals, economy and welfare
of such residents.
Section
2. That the 25th and Southwest Boulevard (PIEA) General Development Plan being
that area of approximately 3.1 acres generally bounded by Southwest Boulevard
and 25th Street on
the
north, Belleview Avenue on the east, 26th Street on the south and a City
alleyway just east of Southwest Boulevard and Southwest Boulevard on the west,
is hereby approved. A copy of said plan is attached hereto and incorporated
herein by reference as Document No. 041081.
Section
3. That the Council has duly made the findings necessary for compliance with
Section 100.300-100.620, RSMo.
Section
4. That said General Development Plan is hereby found to be feasible and in
conformance with the general plan for the development of the community as a
whole.
Section
5. That the ad valorem tax exemption benefits as authorized in Section 100.570,
RSMo, are hereby extended to the plan area to the extent and in the manner as
provided for in said General Development Plan, and subject to the execution of
a development agreement with Planned Industrial Expansion Authority and the
developer.
