ORDINANCE NO. 090469

 

Approving a $160,000.00 Amendment No. 5 with Session Law Firm for legal services in connection with litigation of City of Kansas City, Missouri v. Foley Company and Brentwood Industries and Black & Veatch.

 

WHEREAS the City executed a $50,000.00 contract with the Session Law Firm in September 2006 and has executed 4 amendments for a total City obligation of $775,000; and

 

WHEREAS the Session Law Firm has filed the lawsuit City of Kansas City, Missouri v. Foley Company and Brentwood Industries and Black and Veatch (0516-CV21985) on behalf of the City of Kansas City and continues to represent the City of Kansas City in that litigation; and

 

WHEREAS that litigation currently has a trial setting of July 6, 2009; and

 

WHEREAS Amendment No. 5 will allow Kansas City to receive continued legal services in connection with the lawsuit; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Attorney is hereby authorized, on behalf of the City, to execute a $160,000.00 Amendment No. 5 to its contract with the Session Law Firm for a total contract amount of $935,000.00, from funds previously appropriated in Account No. 10-8110-801000-B. A copy of the contract will be filed in the Office of the City Attorney.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
