ORDINANCE NO. 100393
Authorizing the Director of Water
Services Department to enter into a $5,000,000.00 contract with J. M. Fahey
Construction Company, Contract No. 10008, Citywide Asphalt and Concrete
Repairs; authorizing the Director of Water Services to expend $5,000,000.00 for
the project; authorizing the Director of Finance to return unexpended
appropriations to the appropriate account; and recognizing an emergency.
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section 1. That
the Director of Water Services Department is hereby authorized to execute, on
behalf of Kansas City, Contract No. 10008, in the amount of $5,000,000.00 with
J. M. Fahey Construction Company to make asphalt and concrete repairs to areas
damaged due to repairs of water mains and sewers and also to repair
deteriorated areas at Water Services Department facilities in Kansas City,
Missouri, in Cass, Clay, Jackson, and Platte Counties. A copy of the contract
is on file in the office of the Director of Water Services.
Section 2. That
the Director of Water Services is authorized to expend up to the sum of
$5,000,000.00, including contingencies, from funds previously appropriated to
Account Nos. 11-8010-802010-B ($4,200,000.00), Div of Dist-Pipeline,
11-8110-802040-B ($750,000.00), Maint Div-Swr Repair, and 11-8200-802301-B
($50,000.00), Catch Basin Clng & Rpr, to satisfy the cost of this contract.
Section 3. That
upon completion of this contract, the Director of Finance is hereby authorized
to return the unexpended portion of this appropriation to the Unappropriated
Fund Balance from which it was derived.
Section 4. That this ordinance is recognized as an emergency
measure within the provisions of Section 503 of the City Charter in that it
relates to a public improvement, and shall take effect in accordance with that
section.

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund
from which payment is to be made, each sufficient to meet the obligation hereby
incurred.
