AMENDED
Approving an amendment to a previously approved Community
Unit Project on approximately a 140 acre tract of land generally located east
of Interstate 29 at N. Montclair Street. (9009-CUP-15)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved Community Unit Project on approximately a 140 acre tract of land
generally located east of Interstate 29 at N. Montclair Street, and more
specifically described as follows:
All that part of the Northwest Quarter and all that
part of the Northeast Quarter of Section 18, Township 51, Range 33, Kansas
City, Platte County, Missouri, being bounded and described as follows:
Commencing at the northwest corner of the Northwest Quarter of said
Section 18; thence South 0 27'49" West, along the west line of said
Northwest Quarter, 140.70 feet; thence South 89 10'06" East, 260.82
feet to a point on the easterly line of Interstate Route I-29, as now
established, said point being also the true point of beginning of the
tract to be herein described; thence continuing South 89 10'06" East,
parallel with and 140.70 feet south of the north line of said Northwest
Quarter 2366.60 feet, to a point on the east line of said Northwest
Quarter; thence South 88 53'10" East, parallel with and 140.70 feet south
of the north line of the Northeast Quarter of said Section 18, 660.81 feet
to a point on the West One-Half of the West One-Half of said Northeast
Quarter; thence South 0 30'14" West, along said east line, 2498.03
feet to a point on the south line of said Northeast Quarter; thence North
88 46'24" West, along said south line 657.90 feet, to the southwest
corner of said Northeast Quarter; thence North 0 26'12" East, along
the east line of said Northwest Quarter, 165.64 feet; thence North 88
52'48" West, along the north line of Bale View Resurvey, Fritzdale and
Morning View, all being subdivisions in the City of Platte Woods, Platte
County, Missouri, 1408.24 feet to a point on the easterly right of way
line of the aforementioned Interstate Route I-29; thence North 42
37'41" West, along said easterly right of way line 11.33 feet; thence
North 34 20'55" West along said easterly right of way line, said line
being also the southwesterly line of North Lakes First Plat, a subdivision
of land in Kansas City, Platte County, Missouri, and its southerly
prolongation 297.33 feet to a point on the westerly right of way line of
N. Montclair Street, as now established; thence northerly along said
westerly line along a curve to the right, having an initial tangent bearing
of North 03 30'46" East, a radius of 380.00 feet, an arc distance of
201.04 feet to a point of tangency; thence North 33 49'31" East,
along said westerly line, 240.78 feet to a point of curvature; thence
northerly along said westerly line and its northerly prolongation, on a
curve to the left, tangent to the last described course, having a radius
of 1060.00 feet, an arc distance of 393.23 feet; thence North 84 54'50"
West, 441.30 feet; thence South 58 38'56" West, 365.10 feet to a
point on the easterly right of way line of the aforementioned Interstate
Route I-29; thence northwesterly along said easterly line along a curve to
the right, having an initial tangent bearing of North 30 17'27" West,
a radius of 2682.79 feet, an arc distance of 1435.74 feet; thence North 00
22'07" East along said easterly line, 116.67 feet to the true point
of beginning. Containing 140.49 acres, more or less, except that portion
lying in Platte Woods, a Missouri municipality.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for the entire development for
approval and that the developer construct any
improvements as required by the City Engineer's
Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer grant a Noise and Aviation
Easement to the City.
5. That the developer receive the approval of the
Board of Zoning Adjustment for any subdivision identification
signage.
6. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
7. That the developer dedicate additional
right-of-way for N. Roanridge Road as required by the Department of
Public Works so as to provide a total of 60 feet of
right-of-way for N. Roanridge Road.
8. That the developer submit a traffic study to
the Department of Public Works for approval and that the developer
make any necessary improvements as required by the
traffic study.
9. That the developer construct N. Roanridge Road
from its existing terminus southward to connect with existing N.
Roanridge Road to collector street standards or as
indicated by the approved traffic study.
10. That the developer construct temporary
cul-de-sacs as required by the Department of Public Works.
11. That the developer secure the approval of the
Missouri Highway and Transportation Department prior to working
within any State right of way.
12. That the developer receive the approval of the
Missouri Highway and Transportation Department for access locations
from the development onto N. Roanridge Road.
13. That the developer dedicate additional right of
way for N. Montclair Street as required by the Department of Public
Works so as to provide 30 feet of right of way
as measured from the centerline of N. Montclair
Street or as indicated by the
approved traffic study.
14. That the developer construct two lanes of N.
Montclair Street to collector street standards or as indicated by the
approved traffic study.
15. That the developer construct sidewalks along
both sides of N. Montclair Street.
16. That the developer contribute $200.00 per
dwelling unit for the future improvement of N. Roanridge Road from
south of the site to N.W. 72nd Street provided that the
developer shall receive credit for the cost of
construction of N. Roanridge Road
adjacent to the commercial tract located at the
northwest corner of N. Roanridge
Road and N. Montclair Street.
17. That the developer record a Disclosure of
Proposed Land Development to advise prospective purchasers of the
proposed development on the entire subject property;
such Disclosure shall be recorded with each
plat of the subject property.
18. That the developer submit covenants, conditions
and restrictions to the Law Department for approval.
19. That the developer extend water mains as
required by the Water Services Department.
20. That the developer extend sanitary sewers as
required by the Department of Public Works.
21. That the developer construct all weather roads
and provide for fire protection as required by the Fire Department
prior to construction beyond footings and
foundations.
22. That the developer submit a final plan for
Phase VIII within the single family area to the City Plan Commission
for approval, including detailed information on landscaping,
screening and berming.
23. That the developer submit a final plan for
Phases IA through IVA to the City Plan Commission for approval,
including detailed information on landscaping, screening,
berming, and signage.
24. That the developer require that all
construction traffic enter the site from Barry Road rather than N.W.
72nd Street.
A copy of said Community Unit Project amendment is on
file in the office of the City Clerk under Document No. 960512, which is
attached hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
