COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 070429

 

Amending Section 2-1198, Code of Ordinances, to permit persons who served as an assistant city manager prior to retiring under the terms of the early retirement program of 2003 to reenter employment with the City prior to the expiration of a five-year period following retirement.

 

WHEREAS, as part of the 2003 early incentive retirement program the City chose to limit persons from re-entering City service on a contract basis for five years; and

 

WHEREAS, this provision was designed to enhance the effectiveness of the early retirement program by preventing persons from retiring from City service and then continuing to perform their job duties on a contract basis, thus adversely effecting the savings to be realized from the program; and

 

WHEREAS, to insure an appropriate field of potential trusted advisors to assist the City in establishing a new administration following the election of March 27, 2007; and

 

WHEREAS, the Council finds that the purposes behind the restriction of Section 2-1198, Code of Ordinances, are not impeded by the employment of persons nine months before the expiration of the disqualification period who served in the position of assistant city manager and who retired from City service under the terms of the 2003 early retirement program; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Section 2-1198, Code of Ordinances, is amended to read as follows:

 

Sec. 2-1198. Same Annuitant receiving benefit enhancement ineligible to

reenter city employment for five years.

An annuitant who has received any benefit enhancement under the program established in Section 2-1196 is ineligible to reenter employment in any capacity with the city for a period of five years, unless such annuitant served as an assistant city manager at the time the benefit enhancement was received. This ineligibility includes employment as a contract employee or through a temporary employment agency.
