ORDINANCE NO. 030232

 

Approving an amendment to a previously approved preliminary plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately a 49.75 acre tract of land generally located on the north side of LP Cookingham Drive, approximately 2000 feet west of N. Robinhood Lane. (10426-GP-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately a 49.75 acre tract of land generally located on the north side of LP Cookingham Drive, approximately 2000 feet west of N. Robinhood Lane, and more specifically described as follows:

 

A tract of land in the Southwest Quarter of Section 17, Township 52, Range 33, Platte County, Missouri, being described as follows: Commencing at the northwest corner of said Southwest Quarter; thence South 89E59'35" East along the north line of said Southwest Quarter, a distance of 1933.29 feet, to the point of beginning; thence continuing along said north line North 89E59'35" East, a distance of 644.43 feet to the northeast corner of the said Southwest Quarter; thence South 00E06'04" East along the east line of said Southwest Quarter, a distance of 1988.52 feet to a point being North 00E06'04" East, 661.75 feet from the southeast corner of said Southwest Quarter, also being the southwest corner of said Southeast Quarter; thence North 89E52'40" East parallel with the south line of said Southeast Quarter, a distance of 677.42 feet; thence South 00E06'04" East parallel with the west line of said Southeast Quarter, a distance of 661.75 feet to a point on the south line of said Southeast Quarter; thence North 89E52'40" West along the south line of said Southwest Quarter, a distance of 677.43 feet to the said southeast and southwest corner; thence North 89E46'21" West along the south line of said Southwest Quarter, a distance of 653.30 feet; thence North 00E05'26" East, a distance of 2647.60 feet to the point of beginning. Containing 49.75 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer update the previously approved macro storm drainage study for the overall development as required by the City Engineers Office to address the development amendments along with a detailed study prior to the approval of the next phase and that the developer make the necessary improvements as required by the City Engineers Office.

 


3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area of the entire development exceeds five acres.

 

6. That the developer extend or enlarge water mains and provide easements as required by the Water Services Department.

 

7. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works and the Water Services Department at such time as public sewer facilities are extended within a reasonable proximity of this project or to LP Cookingham Drive and that the developer apply for permits for said extension within sixty (60) days of any code violations requiring the removal of private sewage treatment systems.

 

9. That the developer dedicate additional right of way for LP Cookingham Drive as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of LP Cookingham Drive.

 

10. That the developer construct an eastbound left turn lane with adequate tapers on LP Cookingham Drive at both permanent entrances to the development as required by the Department of Public Works.

 

11. That the developer subordinate all private interest in the area of any right-of-way dedication as required by the Department of Public Works.

 

12. That the developer secure a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

13. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right-of-way.

 

14. That the developer comply with the Kansas City International Airport height zoning restrictions and that the developer construct no structure in this area exceeding those restrictions.

 

15. That the developer grant an Aviation Noise Easement to the City as required by the Aviation Department.

 

16. That the developer submit a final plan to the City Plan Commission for approval for each phase of the development, including detailed information on grading, building elevations, landscaping, lighting, fencing and signage (including elevations) prior to the issue of a building permit.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 030232, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
