Vacating portions of Hillcrest Road from 87th Street to 93rd Street, a section of Fire House Road, north of 93rd Street, and a section of 91st Street west of the railroad right-of-way to allow for the redevelopment of the Bannister Mall site; retaining a utility easement; and directing the City Clerk to record certain documents. (1692-V)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council of Kansas City does hereby find and declare that on the 26th day of August, 2014, a petition was filed with the City Clerk of Kansas City by Cerner Property Development, Inc., for the vacation of the following described rights of way:

 

Hillcrest Road

A tract of land situated in a portion of the Southwest Quarter of Section 24, and the Northwest Quarter of Section 25, Township 48 North, Range 33 West of the 5th Principal Meridian, in the Kansas City, Jackson County, Missouri, said tract being more particularly described as follows:

Commencing at the Northeast corner of the Southwest Quarter of said Section 24; thence North 86 degrees 46 minutes 23 seconds West 774.54 feet along the North line of said Southwest Quarter; thence South 03 degrees 13 minutes 37 seconds West 88.13 feet to a point on the Easterly Right-of-Way line of Hillcrest Road as now established, said point also being the “True Point of Beginning” of the tract herein described. A tract of land situated in a portion of the Southwest Quarter of Section 24, and the Northwest Quarter of Section 25, Township 48 North, Range 33 West of the 5th Principal Meridian, in the Kansas City, Jackson County, Missouri, said tract being more particularly described as follows:

The petition gave the distinct description of the right-of-way to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and due notice of the pendency of said petition has been given in the newspaper doing the city printing, and the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said right-of-way has been obtained in writing, and said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That the Council finds that no private rights will be unreasonably injured or endangered by this vacation and that the public will suffer no unreasonable loss or inconvenience thereby.

 

Section 4. That the following described rights of way are hereby vacated:

However, the City of Kansas City reserves an easement and the right to locate, construct and maintain (or to authorize any franchised utility to locate, construct and maintain) conduits, water, gas and sewer pipes, poles and wire, or any of them over, under, along and across the above-described property. The City of Kansas City shall have at all times the right to go upon the above-described property to construct, maintain and repair the same; and nothing in this vacation action shall be construed so as to grant any right to use the above-described property in any manner as would interfere with the construction or reconstruction and proper, safe and continuous maintenance of the aforesaid uses, and specifically, there shall not be built thereon or thereover any structure (except driveways, paved areas, grass, shrubs and fences) without first securing the written approval of the Director of Public Works. This vacation is additionally subject to the following conditions:

 

1.                  That any existing facilities within the right of way be protected until relocated.

 

2.                  That the developer continues to work with the Kansas City, Missouri Fire Department to strive towards maintaining optimum response times as it relates to the privatization of Hillcrest Road prior to City Council action on this rezoning. Options to be considered include; redesign of the traffic circles, navigation of proposed security gates and possible relocation of Fire Station No. 41.

 

3.                  That Hillcrest Road from 87th to 93rd Street must remain as a fire access road complying with §503.2 of the International Fire Code 2000 (IFC-2000).

 


 

4.                  That water supply/hydrant system shall remain through the demolition process, the reestablished upon arrival of combustible building materials upon the site per § 1412.4 of the International Fire Code 2000 (IFC-2000) and NFPA 241.

 

5.                  That the developer remove and return streetlights to the City as detailed on the utility comment form.

 

Section 5. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri.

 

Section 6. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
