ORDINANCE NO. 040519
Authorizing an agreement
to convey certain electrical equipment to Kansas City Power and Light Company
and authorizing the execution of an easement with Kansas City Power and Light
Company for maintenance and equipment upgrading of this electrical equipment on
City-owned property generally located at 2701 E. Front Street.
WHEREAS, the City
of Kansas City, Missouri desires to convey the electrical transformers and
appurtenances located at the Prospect Avenue Flood Pumping Station for the
purpose of transferring all maintenance and equipment upgrading responsibility
to Kansas City Power and Light Company; and
WHEREAS, it has
been determined that an easement is necessary to maintain and upgrade this
electrical equipment which is located in the vicinity of 2701 E. Front Street;
NOW, THEREFORE,
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Water Services Department is hereby authorized to convey
certain electrical equipment located at 2701 E. Front Street to Kansas City
Power and Light Company who will also assume maintenance and equipment upgrade
responsibilities.
Section 2. That
the Director of the Water Services Department is hereby authorized to execute
an agreement granting an easement to Kansas City Power and Light Company on
City-owned property in Kansas City, Jackson County, Missouri, generally located
at 2701 E. Front Street for the Prospect Avenue Flood Pumping Station.
Property for said easement is legally described as follows:
A tract
of land 10 feet in width being part of Lot 32, Lands of Joseph Guinotte, a subdivision
of land in Kansas City, Jackson County, Missouri, the centerline of which is
described as follows: Beginning at the point of intersection of the
Northwesterly Line of Nicholson Avenue with the Southwesterly Line of Olive
Street (formerly Scott Avenue), as both are now established, being a point 60
feet Southwesterly of the most Easterly corner of Lot 65 in said subdivision as
measured along the Northwesterly Line of said Nicholson Avenue, thence North 39E 25 20 East a distance of 1686.58 feet, thence North 50E34 40 West a distance of 31.08 feet to the True Point of Beginning of
the 10 foot tract of land to be herein conveyed, thence North 59E17 52 West a distance of 115.76 feet, thence North 42E 37 04 West a distance of 37.21 feet to the point of termination.
