Rezoning an area of approximately
4.1 acres generally located west of Missouri 350 between E. 65th Street and E. 67th Street from Districts R-1a and C-2 to District PD-R-1a/C-2, and approving a
development plan for the same. (12370-PD-3)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0761, rezoning an area of approximately 4.1 acres
generally located west of Missouri 350 between E. 65th Street and E. 67th
Street from Districts R-1a (One-Family Dwellings) and C-2 (Local Retail
Business) to District PD/R-1a/C-2 (Planned District/One-Family Dwellings/Local
Retail Business), said section to read as follows:
Section 80-11A0761. That an area
legally described as:
Commencing at the
intersection of the West line of said East half with the Westerly right of way
line of U.S. Highway 50; thence South 00 degrees 24 minutes 56 seconds East
along the West line of said East half, a distance of 494.09 feet to the Point
of Beginning; thence North 89 degrees 41 minutes 46 seconds East, 260.80 feet
to a point on the Westerly right of way of said U.S. Highway No. 50; thence
South 28 degrees 13 minutes 07 seconds East along said right of way, 142.67
feet; thence South 11 degrees 09 minutes 35 seconds East, 246.92 feet; thence
South 79 degrees 10 minutes 17 seconds West, 10.24 feet; thence South 59
degrees 29 minutes 10 seconds West, 285.46 feet; thence South 89 degrees 35
minutes 04 seconds West, 116.34 feet to a point on the West line of said East
half; thence North 00 degrees 24 minutes 56 seconds West along said West line
of the East half, 514.30 feet to the Point of Beginning, containing 3.61 acres,
more or less.
Commencing at the
intersection of the West line of said East half with the Westerly right-of-way
line of U.S. Highway 50; thence South 0024'56" East along the West line
of said East half, a distance of 494.09 feet to the Point of Beginning; start
Tract A thence South 0024'56" East 140.89 feet thence South
8935'04" West a distance of 25.00 feet thence South 6823'58" West a
distance of 65.20 feet thence North 4710'16" West a distance of 137.59
feet thence North 0024'56" East a distance of 43.54 feet, thence North
8008'48" East a distance of 162.59 feet thence North 8935'04" East
a distance of 25.00 feet to the Point of Beginning. Containing 0.51 acres, more
or less.
is hereby rezoned from Districts
R-1a (One-Family Dwellings) and C-2 (Local Retail Business) to District
PD/R-1a/C-2 (Planned District/One-Family Dwellings/Local Retail Business), all
as shown outlined on a map marked Section 80-11A0761, which is attached hereto
and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That
a development plan for the area legally described above is hereby approved,
subject to the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the developer submit a macro/micro storm drainage study to
Development Services for review and acceptance for the entire development when
the final plat is submitted, and that the developer construct any improvements
as required by Development Services.
3.
That the developer request that Booth Avenue be vacated as part of the
final plat application for the subject property.
4.
That the developer obtain the grading consents, and all grading,
temporary construction and drainage/sewer easements from the abutting property
owner prior to submitting any public improvements.
5.
That the developer submit plans for grading, siltation, and erosion
control to Development Services for approval and permitting prior to beginning
any construction activities.
6.
That the developer secure a land disturbance permit from Development
Services prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area equals one acre or more.
7.
That the developer extend sanitary sewers to ensure individual service
is provided to all proposed lots and determine adequacy as required by
Development Services.
8.
That the developer provide a storm water conveyance system to serve all
proposed lots within the development and determine adequacy as required by
Development Services.
9.
That the developer provide adequate sight distance for each drive
connection to Highway 350 as required by Development Services.
10.
That the developer enter into a covenant agreement for the maintenance
of the stormwater detention tract.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
