ORDINANCE NO. 001266

 

Approving a Community Unit Project on an approximately 13.12 acre tract of land generally located on the north side of E. 47th Street, approximately 600 feet west of Pittman Road. (8238-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 13.12 acre tract of land generally located on the north side of E. 47th Street, approximately 600 feet west of Pittman Road, and more specifically described as follows:

 

A tract of land in the Southeast Quarter of the Northeast Quarter of Section 29, Township 49 North, Range 32 West of the 5th Principal Meridian in the City of Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the southeast corner of the Northeast Quarter of said Section 29; thence North 86E58'46" West, 442.05 feet along the south line of the Southeast Quarter of the Northeast Quarter of said Section 29; thence North 02E09'08" East, 30.00 feet to a point on the north right of way line of 47th Street, as now established, said point being the true point of beginning; thence North 86E58'46" West, 195.54 feet, along said north right of way line, to the beginning of a curve concave to the south having a radius of 1,030.00 feet; thence southwesterly 248.46 feet along said northerly right of way line and said curve to the left having a chord bearing South 86E06'36" West, 247.86 feet; thence North 02E07'32" East, 1,316.93 feet to the north line of the Southeast Quarter of the Northeast Quarter of said Section 29; thence South 86E53'01" East, 442.67 feet, along said north line, to the northwest corner of Forty Elms Addition, a subdivision of land according to recorded plat thereof; thence South 02E09'08" West, 1286.35 feet, along the west line of said Forty Elms Addition, to the true point of beginning of the tract herein described. Containing 571,569 square feet or 13.1214 acres, more or less. Subject to all easements and restrictions of record.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer construct any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.


4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for E. 47th Street as required by the Department of Public Works so as to provide a total of 75 feet of right of way as measured from the centerline of E. 47th Street.

 

7. That the developer enter into a deferral agreement with the City as required by the Department of Public Works whereby the developer agrees to improve the north half of E. 47th Street to parkway standards, including construction of sidewalks, at such time as 47th Street is improved adjacent to the east or west.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works.

 

9. That the developer contribute $6,918.14 in lieu of parkland dedication for 30 duplex units (30 x 3 x .006 x $12,811.37) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

10. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

11. That the developer extend water mains as required by the Water Services Department.

 

12. That the developer secure the approval of the Street Naming Committee for all street names prior to submittal of the first final plat.

 

13. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

14. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, signage (including elevations) and building elevations. The final plan shall show trees an average of 40 feet on center along both sides of the private drive.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 001266, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
