ORDINANCE NO. 030002

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0455, rezoning an area of approximately 51.8 acres generally located at the northeast corner of N. Bennington Avenue and N.E. Parvin Road from District M-2a/US (Heavy Industry/Underground Space) to District R-5/US (High Apartments/Underground Space). (12875-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0455, rezoning an area of approximately 51.8 acres generally located at the northeast corner of N. Bennington Avenue and N.E. Parvin Road from District M-2a/US (Heavy Industry/Underground Space) to District R-5/US (High Apartments/Underground Space), said section to read as follows:

 

Section 80-11A0455. That an area legally described as:

 

All that part of Lot 9, Great Midwest Commerce Center District I, a subdivision of land in Kansas City and all that part of the Northeast and Southeast Quarter of Section 4, Township 50, Range 32, Kansas City, all being in Clay County, Missouri, being described as follows: Beginning at the southwest corner of the Northeast Quarter of said Section 4; thence North 0E3138 East, along the west line of said Northeast Quarter, 663.64 feet to the northwest corner of the South One-Half of the Southwest Quarter of said Northeast Quarter; thence South 89E3039 East, along the north line of said South One-Half, 1462.28 feet; thence South 0E4434 West, 32.79 feet; thence South 89E1526 East, 394.73 feet; thence South 0E4434 West, 639.35 feet; thence South 89E1414 East, 340.00 feet to the most northerly northwest corner of said Great Midwest Commerce Center District I; thence South 0E4546 West, along the west line of N. Corrington Avenue, as now established, 100.00 feet; thence North 89E1414 West, 396.84 feet; thence South 64E5941 West, 143.80 feet; thence North 89E1414 West, 86.92 feet; thence South 64E5941 West, 494.97 feet; thence North 25E0019 West, 141.52 feet to a point on the northerly line of said Lot 9; thence South 64E5941 West (Plat-South 65E0000 West), along said northerly line, 387.64 feet; thence South 16E5139 East (Plat-South 16E5120 East), along the westerly line of said Lot 9, 231.45 feet; thence South 67E1532 West, 238.22 feet; thence southerly, along a curve to the right, having an initial tangent bearing of South 22E4428 East, a radius of 200.00 feet, a central angle of 37E2515, an arc distance of 130.62 feet; thence South 14E3352 West, 222.23 feet to a point on the northerly right-of-way line of N.E. Parvin Road, as now established; thence westerly, along said northerly right-of-way line, on a curve to the left, having an initial tangent bearing of North 75E2840 West, a radius of 2922.79 feet, a central angle of 10E0153, an arc distance of 511.72 feet to its intersection with the easterly right-of-way line of N. Bennington Avenue, as now established; thence North 0E3149 East, along said easterly right-of-way line, 150.00 feet; thence North 89E2811 West, along said easterly right-of-way line, 25.00 feet to a point on the west line of said Southeast Quarter; thence North 0E3149 East, along said west line, 851.84 feet to the point of beginning. Except that part on the west being used for road right-of-way. All lying above the top of Winterset Ledge of Limestone Park. Containing 51.83 acres, more or less.

 

is hereby rezoned from at the northeast corner of N. Bennington Avenue and N.E. Parvin Road from District M-2a/US (Heavy Industry/Underground Space) to District R-5/US (High Apartments/ Underground Space), all as shown outlined on a map marked Section 80-11A0455, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
