ORDINANCE NO. 130908

 

Authorizing the City Manager to amend the City’s contract with Union Station Kansas City, Inc. involving management of the Kansas City Museum at Corinthian Hall and storage of the collection; authorizing the City Manager to coordinate assignment of museum responsibilities to the Board of Parks and Recreation; and repealing Section 2-970.6, Code of Ordinances in its entirety.

 

WHEREAS, the City has a current Amended and Restated Management Agreement (the "Agreement") dated July 1, 2007 with Union Station Kansas City, Inc. (“USKC”) over management of the Kansas City Museum at Corinthian Hall; and

 

WHEREAS, pursuant to the Agreement, USKC manages the operations of the Kansas City Museum at Corinthian Hall, maintains the Kansas City Museum collection (the “collection”) and provides storage for the collection; and

 

WHEREAS, the parties desire to amend the Agreement to allow the City to manage the operations of the Kansas City Museum at Corinthian Hall, maintain the entire collection and lease space at USKC facilities and elsewhere for storage of the collection; and

 

WHEREAS, the parties have substantially agreed to changes to the Agreement in a “Management Agreement Amendment Term Sheet” dated November 21, 2013; and

 

WHEREAS, some of the agreed upon changes include:

 

·         City retaining all Museum Levy funds;

·         City leasing approximately 14,600 square feet of storage space at Union Station at a price of $131,000.00 per year;

·         City acquiring the lease for additional storage space located in the caves;

·         City taking over management of the Kansas City Museum at Corinthian Hall;

·         City and USKC agreeing that City may exhibit the collection at Corinthian Hall and both parties may exhibit the collection at other locations under the “Kansas City Museum” brand;

·         City storing and maintaining the entire collection; and

 

WHEREAS, the effective date of the amendment shall be May 1, 2014; and

 

WHEREAS, the Board of Parks and Recreation has a long history of full collaboration with neighborhood groups and business leaders in managing City assets, museums and other tourist sites such as the Kansas City Zoo, the Liberty Memorial and Starlight Theatre; and

 

WHEREAS, it is the desire of the City Council that the Kansas City Museum be handled by the Board of Parks and Recreation due to its ability to maximize resources while working with neighborhood and other groups; and

 

WHEREAS, although the City Council appreciates the input, insight and expertise of the Kansas City Museum Advisory Board, due to management of the museum and collection by Parks and Recreation, there is no longer a need for the Board in its current form; NOW THEREFORE;

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is authorized to amend the City’s Amended and Restated Management Agreement (dated July 1, 2007) with Union Station Kansas City, Inc. involving management of the Kansas City Museum and the collection in substantial compliance with the terms agreed upon by both parties in the Management Agreement Amendment Term Sheet dated November 21, 2013. The term sheet is on file with the City Clerk.

 

Section 2. That the City Manager is authorized to coordinate assignment of responsibilities of Kansas City Museum and collection management to the Board of Parks and Recreation.

 

Section 3. Repealing Section 2-970.6, Code of Ordinances, in its entirety.
