ORDINANCE NO. 900739

 

Approving an amendment to a previously approved preliminary plan in District C-3a2-p on a 57 acre tract of land located at the southeast corner of N. Church Road and N.E. Barry Road. (9815-P-14)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District C-3a2-p on a 57 acre tract of land located at the southeast corner of N. Church and N.E. Barry Road, and more specifically described as follows:

 

A tract of land in the southeast quarter of Section 11 and the northeast quarter of Section 14, Township 51, Range 32, Kansas City, Clay County, Missouri, more particularly described as follows:

 

Commencing at the northwest corner of the southeast quarter of said Section 11; thence south 8918'53" east, along the north line of the southeast quarter of said Section 11, a distance of 991.62 feet; thence south 041'07" west, a distance of 203.71 feet, to a point on the south right of way line of Mo. Hwy. 152 (Barry Road) as now established; thence south 8835'25" east, along said south right of way line, a distance of 350.00 feet; thence north 8622'51" east, along said right of way line, a distance of 501.93 feet; thence south 4636'11" east, along said right of way line a distance of 134.54 feet, to a point on the westerly right of way line of Interstate 35 as now established; thence south 145'05" west, along said westerly right of way line, a distance of 665.37 feet; thence south 939'35" west along said right of way line, a distance of 243.92 feet; thence south 2803'41" west along said right of way line, a distance of 1624.53 feet, to a point on the north line of the north one-half of Section 14; thence south 2803'41" west, along said right of way line, a distance of 445.47 feet; thence departing said right of way line on a bearing of north 6156'19" west, a distance of 860.06 feet to a point on the north line of the northeast quarter of said Section 14; thence north 6156'19" west, a distance of 39.94 feet; thence north 2803'41" east, a distance of 1081.11 feet, to a point of curvature; thence along a curve to the right having a central angle of 3750'55", a radius of 530.00 feet, and an arc length of 350.11 feet; thence north 6554'35" east, a distance of 264.28 feet; thence north 2405'25" west, a distance of 91.76 feet to a point of curvature; thence along a curve to the right having a central angle of 2530'00", a radius of 1104.84 feet, and an arc length of 491.72 feet; thence north 0124'35" east, a distance of 520.00 feet to the point of beginning, containing 2,493,037.515 square feet or 57.2323 acres more or less.

 

 

is hereby approved, subject to the following conditions:

 

1. That the developer limit all freestanding signs to a height not more than 30 feet.

 

2. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

3. That the developer secure a floodplain certificate prior to any work within the 100-year flood boundary.

 

4. That the developer submit a storm drainage study, including consideration for detention as required by the

City Engineer's Office.

 

5. That the developer extend sanitary sewers in the appropriate watersheds to serve each building with a

separate service connection, and further to extend the

sewers to the upstream limits of the watershed on the

subject property.

 

6. That the developer secure a construction permit from the Missouri State Highway and Transportation Department for

all construction within State right of way.

 

7. That the developer extend water mains as required by the City Water Department

 

8. That the developer dedicate 80 feet of right of way for relocated Church Road and improve Church Road to City

standards to a 52 foot back-to-back pavement adjacent and

through the site to point where the subject property

fronts on State Highway right of way and from that point

south to 36 feet of pavement according to Missouri State

Highway and Transportation Department standards; that the

developer construct two lanes of Church Road and a

northbound right-turn lane at N.E. Barry Road at the time

of development of any phase except Phase 1A and that the

developer construct the third and fourth lanes at the

time a building permit is issued for any development

exceeding a total of 150,000 gross square feet on the

subject property.

 

9. That the developer contribute to the I-35/Barry Road Improvement Fund based on $238.00 per peak hour traffic

volume generated by each land use for the project;

provided that the developer shall be given credit for the

cost of constructing one lane of the four lanes for

Church Road based on $103.00 per linear foot.

 


10. That the developer enter into an agreement with the City to contribute to the cost of the traffic signal for

Church Road up to 50% of the cost at the time the State

determines such signal is warranted; provided that

developer shall bear the full cost of the traffic signal

if developer desires installation of the signal prior to

the State's determination.

 

11. That the developer install hard surface roadways, water mains and fire hydrants within 150 feet of any point of

a building prior to construction beyond footings and

foundations.

 

12. That the developer construct a westbound left-turn lane at relocated Church Road and Barry Road intersection as

part of the improvement of two lanes of Church Road; such

turn lane shall be 250 feet in length and in accordance

with the standards of the Missouri Highway and

Transportation Department; and that the developer

construct a second westbound left-turn lane at the time

the third and fourth lanes of Church Road are improved a

distance of 400 feet and further extend the first

constructed westbound left-turn lane from 250 feet to 400

feet.

 

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 900739, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
