COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090669

 

Rezoning an area of approximately 179 acres generally bounded by Swope Parkway and Bruce Watkins Drive on the north, E. 51st Street on the south, The Paseo on the west and a line midway between Wabash Avenue and Prospect Avenue on the east from Districts R-2b, R-4, R-5-p, C-1 and C-2 to District R-1b. (14028-P).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0846, rezoning an area of approximately 179 acres generally bounded by Swope Parkway and Bruce Watkins Drive on the north, E. 51st Street on the south, The Paseo on the west and a line midway between Wabash Avenue and Prospect Avenue on the east from Districts R-2b (Two-Family Dwellings), R-4 (Low Apartments), R-5-p (High Apartments - Limited District), C-1 (Neighborhood Retail Business) and C-2 (Local Retail Business) to District R-1b (One-Family Dwellings), said section to read as follows:

 

Section 80-11A0846. That areas legally described as follows are rezoned as described:

 

That Lot A and Lots 431-434 inclusive and Lots 441-444 inclusive, The Highlands Resurvey, except that part in right of way, and vacated 48th Street and the easterly half of vacated Grove Street and the north half of vacated 48th Terrace lying adjacent said lots, are hereby rezoned from District C-2 (Local Retail Business) to District R-1b (One-Family Dwellings); and

 

That a parcel bounded by the centerlines of Brush Creek Parkway, Swope Parkway, Woodland Avenue, 49th Street and Flora Avenue, also described as all of Lots 25-32, 65-72, 121-135, 154-168, 217-231, 250-264, 313-327 and 345-359 inclusive, The Highlands, and all Lots 384-398, 415, 416, 428-430, 445, 446 and 462 inclusive, The Highlands Resurvey, except that part in right of way, and all vacated streets lying adjacent said lots, is hereby rezoned from Districts R-2b (Two-Family Dwellings), R-4 (Low Apartments), R-5-p (High Apartments - Limited District) and C-1 (Neighborhood Retail Business) to District R-1b (One-Family Dwellings); and

 

That Lots 360-362 inclusive, The Highlands, and Lots 207-209 inclusive, Elm Ridge Park, and Lots 55 and 56, Oldhams 1st Addition are hereby rezoned from District C-1 (Neighborhood Retail Business) to District R-1b (One-Family Dwellings); and

 

That Lot 44, Parkina Place is hereby rezoned from Districts R-2b (Two-Family Dwellings) and C-1 (neighborhood retail business) to District R-1b (One-Family Dwellings); and

 

That an area described as follows: Beginning at the intersection of the east line of The Paseo and the centerline of vacated E. 48th Terrace, thence east along said centerline to the west line of Flora Avenue, thence south along said west line to the south line of E. 49th Street, thence east along said south line to the east line of Woodland Avenue, thence north along said east line to the south line of Swope Parkway, thence east along said south line to the southwesterly line of U. S. Highway 71, thence southeasterly along said southwesterly line to the northeast corner of Lot 218, Prospect Hill, thence south along the east line of Lots 218-227 inclusive, Prospect Hill and the east line of Lot 4 and Lots 19-30 inclusive, Block 1, Cole Grove to the north line of E. 59th Street, thence west along said north line to the east line of The Paseo, thence north along said east line to the point of beginning, all rights of way as now established, and excepting the aforementioned Lots 360-362 inclusive, The Highlands, and Lots 207-209 inclusive, Elm Ridge Park, and Lots 55 and 56, Oldhams 1st Addition and Lot 44, Parkina Place, and also excepting Lots 148 and 149, Elm Ridge Park, is hereby rezoned from District R-2b (Two-Family Dwellings) to District R-1b (One-Family Dwellings);

 

all subdivisions and rights of way in Section 28, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, all as shown outlined on a map marked Section 80-11A0846, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved. A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
