COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 001613

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0327, rezoning an area of approximately .25 acres generally located at the northeast corner of West 12th Street and Liberty Street from District C-3a2 (Intermediate Business, High Buildings) to District PD/C-3a2 (Planned District/Intermediate Business, High Buildings), and approving a development plan for the same. (12496-PD-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0327, rezoning an area of approximately .25 acres generally located at the northeast corner of West 12th Street and Liberty Street from District C-3a2 (Intermediate Business, High Buildings) to District PD/C-3a2 (Planned District/Intermediate Business, High Buildings), said section to read as follows:

 

Section 80-11A0327. That an area legally described as:

 

TRACT I: All of Lot 23 in Block 52, and all that part of Lot 24 in said Block 52, all in Turner and Companies Addition to Kansas City, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof bounded as follows: Beginning at a point in the north line of said Lot 24, 3.12 feet east of the northwest corner thereof; thence south to a point on the south line of said Lot which point is 3.25 feet east of the southwest corner of said Lot; thence east along the south line of said Lot to the southeast corner thereof; thence north along the east line of said Lot to the northeast corner thereof; thence west along the north line of said Lot to point of beginning.

 

TRACT II: All that part of Lot 24 in Block 52, Turner and Companies Addition to Kansas City, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, bounded as follows: Beginning at the northwest corner of said Lot 24; thence east along north line of said Lot to a point 3.12 feet east of said northwest corner; thence south to a point on the south line of said Lot which point is 3.25 feet east of the southwest corner of said Lot; thence west along the south line of said Lot to southwest corner of said Lot; thence north with the west line of said Lot to point of beginning. Also all of Lot 25 in said Block 52; also all of that strip or parcel of land adjoining said Lot 25 and bounded on the west by the west line of the Southeast Quarter of the Northwest Quarter of Section 6, Township 49, Range 33, on the east by the west line of the said Lot 25, on the south by the north line of 12th Street, and on the north by the north line of said Lot 25, projected west.

 

is hereby rezoned from District C-3a2 (Intermediate Business, High Buildings) to District PD/C-3a2 (Planned District/Intermediate Business, High Buildings), all as shown outlined on a map marked Section 80-11A0327, which is attached hereto and made a part hereof, and which is hereby adopted


as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer improve the east half of Liberty Street to residential street standards as required by the Department of Public Works, including construction of curbs, gutters and sidewalks and installation of streetlights.

 

4. That the developer install streetlights on West 12th Street adjacent to the property as required by the Department of Public Works.

 

5. That the developer improve the platted public alley as required by the Department of Public Works.

 

6. That the developer receive the approval of the Board of Zoning Adjustment for parking and signage variances.

 

7. That the developer contribute $5,227.04 in lieu of parkland dedication for 34 multi-family units (34 x 3.7 x .006 x $12,811.37) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

8. That the developer secure a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

9. That the developer receive approval of an encroachment ordinance from the City Council to allow the existing garage to remain in the public right of way.

 

10. That the developer submit Certificate of Surveys to the Department of City Development for approval prior to the sale of any individual units.

 

11. That the developer record a notice describing the conditions in the vicinity of the area rezoned in this ordinance which are caused by or attributable to the land uses of the properties in the vicinity. The form of the notice must be approved by the Director of the Department of City Development.

 

12. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 001613, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
