ORDINANCE NO. 050682
Waiving the requirement that a
department cannot enter into a contract for professional services with a law
firm that represents a party in litigation against the City for a contract in
which White, Goss, Bowers, March, Schulte & Weinsenfels, P.C. would be a
subcontractor.
WHEREAS, the City
desires to enter into a contract for professional services with Lutjen, Inc. to
analyze alternative processes for sewer construction financed by contractors;
and
WHEREAS, as a part of
this professional services contract, the legal services of White, Goss, Bowers,
March, Schulte & Weinsenfels, P.C. are required; and
WHEREAS, White, Goss,
Bowers, March, Schulte & Weinsenfels, P.C. currently represents various
parties in litigation against the City; and
WHEREAS, under
Section 2-83, Code of Ordinances, a department cannot enter into a contract for
professional services with a law firm that represents a party in litigation
against the City absent a waiver from the City Council; and
WHEREAS, it is in the
best interests of the City that the waiver be obtained so that this law firm
can assist in analyzing alternative processes for sewer construction financed
by contractors; NOW, THEREFORE,
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That the
requirement that a department cannot enter into a contract for professional
services with a law firm that represents a party in litigation against the City
is waived as it applies to a contract with Lutjen, Inc. wherein the law firm of
White, Goss, Bowers, March, Schulte & Weinsenfels, P.C. will serve as an
approved subcontractor.
