COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 190336
Authorizing the City Manager to enter into a Funding
Agreement with the Tax Increment Financing Commission for a sanitary sewer line
project along N. Arlington Avenue; appropriating $1.6 million in Fund No. 3090,
the Capital Improvements Fund; and recognizing this ordinance as having an
accelerated effective date.
WHEREAS,
pursuant to the Real Property Tax Increment Financing Allocation Act, Section
99.800, RSMo 1988, et seq., as amended, on November 6, 2014, the City Council ,
by way of Committee Substitute for Ordinance No. 140916, approved the Arlington
Road Tax Increment Financing Plan, which has been amended from time to time
(the “Plan”); and
WHEREAS, the
Plan provides, among other things, for the installation of 6,500 linear feet of
sanitary sewer lines along N. Arlington Avenue between Parvin Road and Shoal
Creek; and
WHEREAS, the
sanitary sewer line will be constructed by the
developer, Hunt Midwest Real Estate Development, Inc.; and
WHEREAS, the
City, pursuant to Resolution No. 150090, contemplates contributing funds toward
the actual costs of constructing the Project that are identified by the Plan
and that have been certified by the Tax Increment
Financing Commission of the City of Kansas City, Missouri (“Commission”),
pursuant to a Redevelopment Agreement, and such costs are estimated to be One
Million Six Hundred Thousand Dollars ($1,600,000.00); and
WHEREAS, the
City and the Commission desire to enter into an Agreement for the purpose of funding
the Project in an amount not to exceed $1,600,000.00; NOW THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the City Manager is authorized to enter into a Funding Agreement between the
City and the Tax Increment Financing Commission
of the City of Kansas City, Missouri for the
purpose of providing the City’s contribution (“City’s
Contribution”) for a sanitary sewer line (“the Project”) along N.
Arlington Avenue between Parvin Road and Shoal Creek. A copy of the agreement is located in the office of the
Director of Water Services.
Section 2. That
the sum of $ 1,600,000.00 is hereby appropriated from the Unappropriated Fund
Balance of the Capital Improvements Fund to the following account:
20-3090-808081-B-89008243 Arlington
Road Sewer Contribution $1,600,000.00
Section 3. That
the Director of Water Services is hereby authorized to expend up to
$1,600,000.00 for the City’s contribution to the Project.
Section 4. That
the Director of Water Services is designated requisitioning authority for
Account No. 20-3090-808081.
Section 5. That
this ordinance is recognized as an ordinance with an accelerated effective date
as provided by Section 503(a)(3)(C) of the City Charter, in that it
appropriates money, and shall take effect in accordance with that section.
I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund
from which payment is to be made, each sufficient to meet the obligation hereby
incurred.
