COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 951318

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2606, rezoning an area of approximately 42 acres generally located at the southeast corner of Tiffany Springs Road and N. Congress Avenue from Districts GP-3 (Regional Business) and GP-4 (High Density Residential Uses) to District GP-3 (Regional Business), and approving a development plan for the same. (5935-GP-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2606, rezoning an area of approximately 42 acres generally located at the southeast corner of Tiffany Springs Road and N. Congress Avenue from Districts GP-3 (Regional Business) and GP-4 (High Density Residential Uses) to District GP-3 (Regional Business), said section to read as follows:

 

Section 65.010A2606. That an area legally described as:

 

That part of the Southeast 1/4 of Section 1, T51N, R34W of the 5th P.M., Kansas City, Platte County, Missouri, described as follows: Beginning at the point of intersection of the southerly right-of-way line of N.W. Tiffany Springs Road and the west line of said Southeast 1/4, being 30 feet south of the northwest corner of said Southeast 1/4; thence south on said west line, 1423 feet, more or less, to the westerly prolongation of the south line of Lot 1, The Lakes Executive Hills North, a subdivision of land in Kansas City, Platte County, Missouri; thence east on said westerly prolongation, 370 feet, more or less, to the southwest corner said Lot 1; thence north on the west line of said Lot 1 to the southerly right of way line of said Donovan Drive; thence easterly on said southerly right of way line to the northeast corner of said Lot 1; thence south on the east line of said Lot 1, to the southeast corner of said Lot 1, also being a point on the south line of Lot 2, Barron International Plaza, a subdivision of land in Kansas City, Platte County, Missouri; thence east on said south line, 210 feet to the southeast corner of said Lot 2; thence north on the easterly line of said Lot 2, 313 feet to the southerly line of said Lot 2; thence easterly on said southerly line, 190 feet, more or less, to a point on the westerly right of way line of Interstate Highway 29; thence northerly on said westerly right of way line, 159 feet, more or less, to the southerly right of way line of said Donovan Drive; thence easterly on said southerly right of way line, 28 feet, more or less, to the westerly right of way line of said Interstate Highway 29; thence northwesterly on said westerly right of way line to the southerly right of way line of said N.W. Tiffany Springs Road; thence westerly on said southerly right of way line to the point of beginning. (Tract contains 41.5 acres, more or less)

 

 

is hereby rezoned from Districts GP-3 (Regional Business) and GP-4 (High Density Residential Uses) to District GP-3 (Regional Business), all as shown outlined on a map marked Section 65.010A2606, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

5. That the developer dedicate right of way for N. Congress Avenue as required by the Department of Public Works so as to provide 40 feet of right of way as measured

from the centerline of N. Congress Avenue.

 

6. That the developer improve one-half of N. Congress Avenue to arterial street standards.

 

7. That the developer dedicate right of way for Tiffany Springs Road as required by the Department of Public Works so as to provide 50 feet of right of way as measured

from the centerline of Tiffany Springs Road.

 

8. That the developer improve one-half of Tiffany Springs Road to arterial street standards.

 

9. That the developer dedicate additional right of way for N.W. Donovan as required by the Department of Public Works so as to provide 60 feet of right of way for N.W.

Donovan.

 

10. That the developer improve N.W. Donovan to collector street standards.

 

11. That the developer receive the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

12. That the developer extend sanitary sewers as required.

 

13. That the developer extend water mains as required by the Water Services Department.

 

14. That the developer comply with the KCI Airport Height Zoning restrictions.

 

15. That the developer submit a landscaping plan to the Director of the Department of City Development for approval, including a substation screening plan for adjacent

properties.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 951318, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
