ORDINANCE NO. 020222

Rescinding Ordinance No. 011517 and enacting in lieu thereof a new ordinance authorizing the Director of City Planning and Development to offer for sale the lot at 11th Street and Hereford Drive, and correcting the legal description of Tracts 1-6.

WHEREAS, all City Departments have been notified that this land was in excess to the needs of the City and no interest has been expressed in retaining them for future public use; and

WHEREAS, the incorrect legal description of Tracts 1-6 in Ordinance No. 011517 needs to be corrected; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Ordinance No. 011517, dated November 8, 2001 with an incorrect legal description of Tracts 1-6 is hereby rescinded, and the Director of City Development is hereby authorized to offer for sale, by competitive bids, the vacant lot at 11th Street and Hereford Drive, said property being more particularly described as follows:

TRACT 1:

Part of the Southwest of the Northeast of Section 6, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning on the West line of vacated Summit Street (formerly High Street) 75 feet North of the North line of 11th Street produced West; thence North 100 feet; thence West 79 feet; thence Southwesterly to a point 90.7 feet due West of the beginning; thence East 90.7 feet to the point of beginning, together with that part of the West half of vacated Summit Street (vacated under City Ordinance No. 14920 dated September 27, 1951, a copy of which was recorded October 8, 1951 as Document No. B-35350 in Book B-4453 at Page 541) lying east of and adjacent, but except that part in W. Kirk Drive, also known as Hereford Drive, (as established in Ordinance No. 15006 passed October 22, 1951, a copy of which was recorded November 21, 1951 as Document No. B-39407 in Book B-4456 at page 517 and as also established by the deed of dedication recorded November 21, 1951 as Document No. B-39409 in Book B-4456 at page 520) and also except that part condemned by the State of Missouri in the Circuit Court of Jackson County, Missouri in Case No. 665495 as evidenced by the Report of Commissioners recorded January 2, 1969 as Document No. K-37805 in Book K-87 at Page 1475.

TRACT 2:

Beginning at a point on the North line of 11th Street in the City of Kansas, now Kansas City, Missouri, produced Westerly 50 feet West of the West line of COATES ADDITION of said City; thence Westerly along the prolongation of said North line of 11th Street, 95 feet; thence North 4 degrees East, 65.5 feet; thence Easterly and parallel with the North line of the

prolongation of said street, 90.7 feet; thence Southerly parallel with the West line of said COATES ADDITION, 65 feet to the point of beginning, ALSO a tract of land described as follows: Beginning at the Northeast corner of said above described land; thence Northwesterly along the prolongation of the East line of said tract, 10 feet; thence Westerly and parallel to the North line of said tract, 90 feet; thence Southerly 10 feet, more or less, to the Northwest corner of said tract; thence Easterly along the North line of said tract to the point of beginning, all being in the Southwest of the Northeast of Section 6, Township 49, Range 33, in Kansas City, Jackson County, Missouri, together with that part of the West half of vacated Summit Street lying East of the adjacent (vacated under City Ordinance No. 14920 dated September 27, 1951, a copy of which was recorded October 8, 1951 as Document No. B-35350 in Book B-4453 at Page 541) lying east of and adjacent, but except that part condemned by the State of Missouri in the Circuit Court of Jackson County, Missouri in Case No. 665495 as evidenced by the Report of Commissioners recorded January 2, 1969 as Document No. K-37805 in Book K-87 at Page 1475.

TRACT 3:

Part of the Southwest of the Northeast of Section 6, Township 49, Range 33, described as follows: Commencing at a point on the North line of 11th Street produced West, 50 feet from the West line of COATES ADDITION to City of Kansas, now Kansas City, Jackson County, Missouri, and running thence Southward and perpendicular to said North line of 11th Street, produced, 60 feet to South line of said 11th Street produced; thence West on said South line of said 11th Street produced, 94 feet thence North along edge of the bluff, 60 feet to the North line of 11th Street produced; thence East along said 11th Street produced, 94 feet to beginning, in Kansas City, Jackson County, Missouri, together with that part of the West half of vacated Summit Street (vacated under City Ordinance No. 14920 dated September 27, 1951, a copy of which was recorded October 8, 1951 as Document No. B-35350 in Book B-4453 at Page 541) lying east of and adjacent, but except that part condemned by the State of Missouri in the Circuit Court of Jackson County, Missouri in Case No. 665495 as evidenced by the Report of Commissioners recorded January 2, 1969 as Document No. K-37805 in Book K-87 at Page 1475.

TRACT 4:

Part of the Southwest of the Northeast of Section 6, Township 49, Range 33, in Kansas City, Jackson County, Missouri, particularly described as follows: Beginning at the intersection of the South line of 11th Street, produced West, with the West line, produced South, of COATES ADDITION, a subdivision in said city; thence South along the Southerly prolongation of said West line of COATES ADDITION, 75 feet to a point; thence West and parallel with the South line of 11th Street, produced West 133 feet, more or less, to the East line of West Terrace Park, as established by Ordinance of Kansas City, Missouri No. 11430; thence Northerly along the Easterly line of said park to the intersection thereof with the Westerly prolongation of the South line of 11th Street, at a point 144 feet, more or less, West of the place of beginning; thence East along said South line of 11th Street, produced West, a distance of 144 feet, more or less, to the point of beginning, but except that part condemned by the State of Missouri in the Circuit Court of Jackson County, Missouri in Case No. 665495 as evidenced by the Report of Commissioners recorded January 2, 1969 as Document No. K-378095 in Book K-87 at Page 1475.

TRACT 5:

That part of the Southwest of the Northeast of Section 6, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning 75 feet South of the intersection of the South line of 11th Street, produced West, with the West line of COATES ADDITION, produced South; thence South 45 feet; thence West 133 feet to the edge of bluff; thence Northerly 45 feet, more or less, along the edge of bluff to appoint 137 feet west of the place beginning, thence East to the point of beginning, but except that part condemned by the State of Missouri in the Circuit Court of Jackson County, Missouri in Case No. 665495 as evidenced by the Report of Commissioners recorded January 2, 1969 as Document No. K-37805 in Book K-87 at Page 1475.

TRACT 6:

All of that part of the Northeast of Section 6, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point 180 feet South of the Southwest corner of Block 9, COATES ADDITION, an addition in Kansas City, Missouri; thence South 40 feet more or less to the North line of COATES AND HOPKINS TWELFTH STREET SUBDIVISION, in Kansas City, Missouri; thence West along said North line 133 feet, more or less, to the edge of the bluff; thence North along the edge of the bluff to a point due West of the point of beginning; thence East to the point of beginning, but except that part condemned by the State of Missouri in the Circuit Court of Jackson County, Missouri in Case No. 665495 as evidenced by the Report of Commissioners recorded January 2, 1969 as Document No. K-37805 in Book K-87 at Page 1475.
