COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060290

 

Rezoning an area of approximately 1.90 acres generally located south of I-29 and I-635 and west of Gateway Drive/US-71 Hwy from District R-1a to District R-3. (13491-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0664, rezoning an area of approximately 1.90 acres generally located south of I-29 and I-635 and west of Gateway Drive/US-71 Hwy from District R-1a (One-Family Dwellings, Medium Density) to District R-3 (Low Apartments, Low Density), said section to read as follows:

Section 80-11A0664. That an area legally described as:

All that part of the Northwest Quarter of Section 33, Township 51, Range 33 in the City of Kansas City, Platte County, Missouri described as follows: Commencing at the Southeast corner of the Northwest Quarter of said Section 33; thence North 89 degrees 25 minutes 43 seconds West, along the South line of the Northwest Quarter of said Section 33, a distance of 126.31 feet to a point 99.02 feet Right of station 214+71.43 Gateway Drive (Originally US Route 71), said point also being the Point of Beginning of the tract of land herein to be described; thence continuing North 89 degrees 25 minutes 43 seconds West, along the South line of the Northwest Quarter of said Section 33, a distance of 726.46 feet to a point on the Easterly right of way line of Interstate 635, said point being 446.16 feet Right of station 112+71.60; thence, along said right of way line, North 64 degrees 40 minutes 19 seconds East, a distance of 358.52 feet to a point 590.00 feet Right of station 116+00 of said Interstate 635 as referenced in Book 263, Page 85, Paragraph 11.11; thence continuing along said right of way line, North 86 degrees 59 minutes 25 seconds East, a distance of 160.00 feet; to a point on the Southerly right of way line of Interstate 29; thence, along said right of way line, South 88 degrees 52 minutes 57 seconds East, a distance of 146.44 feet to a point on the Westerly right of way line of said Gateway Drive, said point being 192.80 feet Right of station 213+03.90 as referenced in Book 263, Page 85, Paragraph 11.11; thence, along said right of way line, South 28 degrees 19 minutes 38 seconds East, a distance of 177.12 feet to a point 111.00 feet Right of station 214+61.00 of said Gateway Drive as referenced in Book 263, Page 85, Paragraph 11.11; thence North 89 degrees 10 minutes 42 seconds East, a distance of 10.09 feet to a point 100.91 feet Right of station 214+61.00 of said Gateway Drive; thence South 11 degrees 05 minutes 03 seconds East, a distance of 10.60 feet to the Point of Beginning. Said tract of land contains 1.90 acres more or less. 

is hereby rezoned from District R-1a (One-Family Dwellings, Medium Density) to District R-3 (Low Apartments, Low Density) all as shown outlined on a map marked Section 80-11A0664, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

  Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
