COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 980433

 

Approving a Community Unit Project on an approximately 5.47 acre tract of land generally located approximately 360 feet north of the northeast corner of N. Roanridge Road and N. Montclair Street. (9009-CUP-22)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 5.47 acre tract of land generally located approximately 360 feet north of the northeast corner of N. Roanridge Road and N. Montclair Street, and more specifically described as follows:

 

A tract of land located in the Northwest Quarter of Section 18, Township 51 North, Range 33 West of the 5th Principal Meridian in Kansas City, Platte County, Missouri, being more particularly described as follows: Beginning at the southwest corner of Lot 1A, Kelly Crossing, a subdivision in the City of Kansas City, Platte County, Missouri, said point also being on the northeasterly right of way line of N.W. Roanridge Road, as now established; thence North 5838'56" East on the south line of Lot 1A of said Kelly Crossing, a distance of 261.90 feet to a point on the south line of Tract A, of said Kelly Crossing; thence North 8254'14" East on said south line, a distance of 149.11 feet; thence continuing South 5717'42" East on said south line, a distance of 190.91 feet; thence continuing South 5824'35" East on said south line, a distance of 182.52 feet to a point on the northwesterly right of way line of N. Montclair Street, as now established; thence on a curve to the right with an initial tangent bearing of South 2342'22" West, a radius of 1060.00 feet, chord bearing of South 2845'12" West, a chord distance of 187.42 feet and an arc distance of 187.66 feet; thence continuing South 3349'31" West on said right of way line, a distance of 178.32 feet; thence North 3420'55" West, a distance of 176.05 feet; thence North 6723'15" West, a distance of 117.53 feet; thence South 5539'05" West, a distance of 152.92 feet to a point being on the northeasterly right of way line of N.W. Roanridge Road; thence North 3420'55" West on said right of way line, a distance of 111.11 feet; thence continuing on said right of way line on a curve to the right having a radius of 2682.79 feet, a chord bearing of North 3219'11" West, a chord distance of 189.96 feet, an arc distance of 190.00 feet to the point of beginning, along with all of Tract A, Kelly Crossing, a subdivision in the City of Kansas City, Platte County, Missouri, according to the recorded plat thereof. Contains 5.47 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 


2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure the approval of the Board of Zoning Adjustment for any subdivision identification signs.

 

6. That the developer grant a Noise and Aviation Easement for each phase to the City and file same with each final plat as required by the Aviation Department.

 

7. That the developer petition for the vacation of the excess right of way on the west side of N. Montclair Street as required by the Department of Public Works.

 

8. That the developer provide a 30 foot setback for all structures from N. Montclair Street if the excess right of way on the west side of N. Montclair Street is not vacated at the time of the submittal of the final plat.

 

9. That the developer provide cross-access easements with each final plat as required by the Department of Public Works.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer extend sanitary sewers as required by the Department of Public Works.

 

12. That the developer provide for fire protection as required by the Fire Department.

 

13. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

14. That the developer require that all construction traffic enter the site from N.W. Barry Road rather than N.W. 72nd Street as required by the Department of Public Works.

 

15. In the event that the parkland dedication requirement is not satisfied, the developer shall contribute $12,360.67 in lieu of parkland dedication for 96 multi-family units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

16. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, signage, screening, berming and fencing.

 

A copy of said Community Unit Project plan amendment is on file in the office of the City Clerk under Document No. 980433, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
