ORDINANCE NO. 140506

 

Declaring certain real property in the Oak Point Project surplus to the City’s needs; authorizing the Director of the General Services Department to convey these surplus parcels to the Land Clearance for Redevelopment Authority of Kansas City, Missouri; and further authorizing the execution of related documents.

WHEREAS, the City Manager has determined on behalf of all City departments that all parcels of real property owned by, or to be acquired by, the City within the boundaries of the Oak Point Project area are considered in excess of the needs of the City and no interest has been expressed by any City department in retaining such parcels for public use; and

WHEREAS, these properties in the Oak Point Project area have been identified for redevelopment by the City Manager and thus are surplus to the City’s needs; and

WHEREAS, on April 28, 2011, the City Council passed Second Committee Substitute for Ordinance No. 110300, which authorized the City Manager to enter into a contract with the Economic Development Corporation of Kansas City (“EDC”), the Land Clearance for Redevelopment Authority of Kansas City (“LCRA”), the Economic Development Corporation Charitable Fund (“EDCCF”) and the EDC Loan Corporation (“EDCLC”) for the transfer and management of assets of the Housing and Economic Development Financial Corporation and the City, in part, for the continued development of various projects (“Asset Transfer Contract”); and

WHEREAS, on February 2, 2012, the City Council passed Ordinance No. 120052, As Amended, which authorized the City Manager to amend the Asset Transfer Contract to allow for additional properties, including those at Oak Point, to be transferred to the LCRA and to be included in the maintenance budget; and

WHEREAS, Oak Point is generally located at: Project A - within the boundaries of 38th and 39th Streets, Elmwood to Kensington Avenues, and Project B - on lots on Norton Avenue at 43rd Street, and the City has an obligation to the U.S. Department of Housing and Urban Development (“HUD”) to complete this project; and

WHEREAS, all of the tracts listed below are within the Oak Point Project area and the Oak Park Urban Renewal Area; and

WHEREAS, the City will direct the Land Clearance for Redevelopment Authority to convey the tracts listed below in furtherance of the continued development of the Oak Point Project area and the elimination of blight within that Project area; and 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri is a public body corporate and politic duly organized and existing pursuant to Section 99.330, RSMo, having among its powers the redevelopment of blighted areas and the power of eminent domain; and 

WHEREAS, the parcels of real property set out below are situated within the Oak Park Urban Renewal Area within which the Land Clearance for Redevelopment Authority of Kansas City, Missouri has the power of eminent domain; and  

WHEREAS; Section 99.580, RSMo, of the Land Clearance for Redevelopment Authority Law provides, in pertinent part, that: “[f]or the purpose of aiding and cooperating in the planning, undertaking or carrying out of a land clearance project located within the area in which it is authorized to act, any public body may, upon such terms, with reasonable consideration, as it may determine: (1) Dedicate, sell, convey or lease any of its interest in any property, or grant easements, licenses or any other rights or privileges therein to an authority . . .” and the City is such a public body; NOW, THEREFORE,  

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Council finds and determines that the properties, whose Jackson County property tax parcel identification numbers, legal descriptions and common street addresses, are set out below, are surplus to the City’s needs:

Tract 1. Parcel No. 31-410-02-14-00-0-00-000 

Benton View Lot 408, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

Commonly known as 4346 Norton, Kansas City, Jackson County, Missouri

Tract 2. Parcel No. 31-410-02-19-00-0-00-000 

Benton View Lot 414, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

Commonly known as 4326 Norton, Kansas City, Jackson County, Missouri

Tract 3. Parcel No. 31-410-15-01-00-0-00-000 

Benton View Lot 407, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

Section 2. That the Council determines that, if there is any inconsistency or ambiguity between a legal description and a corresponding property tax parcel identification number or common street address set out above, the legal description shall control.

Section 3. That the Director of the General Services Department is hereby authorized to transfer each of the properties listed above to the Land Clearance for Redevelopment Authority of Kansas City, Missouri for the above-described purposes and said Director is further authorized to execute any real estate or other documents needed to effectuate the transactions noted herein.
