ORDINANCE NO. 061060

 

Accepting various Missouri Warranty Deeds, conveying to the City of Kansas City, Missouri, certain properties in Clay County, Missouri, all for public use as for the Birmingham Waste Water Treatment Plant Expansion and directing the City Clerk to record this ordinance with the Clay County Recorders Office.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That various deeds in Clay County, executed by the following persons, for the expansion of the Birmingham Waste Water Treatment Plant and which appear of record at the respective books and pages as follows, are hereby accepted:

1.                  James Bynum and Gail M. Bynum; recorded in Instrument No. 2006026318, Book 5409 Page 117; legally described as: The North 55 acres of the West Half of the Northeast Quarter of Section 23, township 50, Range 32 in Kansas City, Clay county, Missouri, Except that part condemned by the United States of America by Court Order filed September 19, 1941 in Book 357 at Page 9, Except that part lying within the right of way of the Birmingham Drainage District Levee, and Except any part in roads.

 

2.                  Sondra M. Keefe and Bob Keefe, wife and husband, John W. Wurzer and Jane Ann Wurzer, husband and wife, and Lawrence R. Wurzer and Georgianna Wurzer, husband and wife, as to an undivided 1/3 interest; and Beverly Jane Reed and Jim Reed, wife and husband, Lisa Joan Puhl and Joseph A. Puhl, wife and husband, Mary Carolyn Erickson f/k/a Mary Carolyn Reed and Reed S. Erickson wife and husband, and Mark Warren Reed and Michelle Reed, husband and wife, as to an undivided 1/3 interest; as recorded in Instrument No. 2006039643, Book 5489 Page 96; and Betty Ann Woods, Trustee of the Testamentary Trust of Marguerite J. Morris dated February 23, 1996, created by said Will, as to an undivided 1/3 interest as recorded in Instrument No. 2006039644, Book 5489 Page 97; legally described as: All of the Northwest Quarter of Section 23, Township 50, Range 32, Kansas City, Clay County, Missouri, lying Northeasterly of the present high bank of the Missouri River, EXCEPT any part thereof within that part condemned by the United States of America in the District Court of the United States for the Western District of Missouri, Western Division in Civil Docket No. 314, a copy of the court Order being filed in the Deed Records of Clay County, in Book 357 at Page 9.

 

Section 2. That upon the effective date of this ordinance the City Clerk is hereby directed to record a copy of this ordinance in the Office of the Recorder of Deeds for Clay County, Missouri, as evidence of the acceptance of the herein described property by the City for public use purposes.
