ORDINANCE NO. 031066

 

Approving the preliminary plat of The Reserves on approximately a 5.9 acre tract of land generally located on both sides of N. Flora Avenue, extended north of Missouri Route 152. (SD 1058)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of The Reserves on approximately a 5.9 acre tract of land generally located on both sides of N. Flora Avenue, extended north of Missouri Route 152, and more specifically described as follows:

 

All that part of the West Half of the Northeast Quarter of the Southwest Quarter of Section 1, Township 51, Range 33, Kansas City, Clay County, Missouri, described as follows: Commencing at the northeast corner of the Southwest Quarter of said Section 1; thence North 87E41'10" West along the north line of the Southwest Quarter of said Section 1, a distance of 661.93 feet to the northeast corner of the West One-Half of Northeast Quarter of the Southwest Quarter of said Section 1, said point being the point of beginning of the tract of land herein to be described; thence South 00E45'56" West along the east line of the West-Half of the Northeast Quarter of the Southwest Quarter of said Section 1, a distance of 424.59 feet to the north right of way line of Missouri State Highway No. 152; thence North 81E49'53" West along the north right of way line of Missouri State Highway No. 152, a distance of 159.07 feet; thence North 84E13'40" West along the north right of way line of Missouri State Highway No. 152, a distance of 362.66 feet; thence North 67E15'07" West along the north right of way line of Missouri State Highway No. 152, a distance of 152.85 feet to the west line of the West-Half of the Northeast Quarter of the Southwest Quarter of said Section 1; thence North 00E36'38" East along the west line of the West-Half of the Northeast Quarter of the Southwest Quarter of said Section 1, a distance of 333.11 feet to northwest corner of the West One-Half of the Northeast Quarter of the Southwest Quarter of said Section 1; thence South 87E41'10" East along the north line of the Southwest Quarter of said Section 1, also being the south line of Willow Brooke 7th Plat and Willow Brooke 9th Plat, both subdivisions of land in the City of Kansas City, Clay County, Missouri, a distance of 661.93 feet to the point of beginning. Said tract of land contains 5.98 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a micro/micro storm drainage study for the entire development to the City Engineers Office for approval, prior to approval of the plat, and that the developer make any necessary improvements as required by the City Engineer's Office.

 

3. That the developer extend water mains as required by the Water Services Department.

 

4. That the developer extend sanitary sewer mains as required by the Department of Public Works.

 

5. That the developer design and construct all interior streets to City standards as required by the Department of Public works, including construction of curb, gutter, storm sewers, and sidewalks and installation of streetlights.

 

6. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.

 

7. That the developer subordinate all private interest in the area of any right of way dedication as required by the Department of Pubic Works.

 

8. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

9. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

10. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five acres.

 

11. That the developer extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

12. That the developer obtain a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities with the floodplain.

 

13, That the developer receive the approval of the Board of Zoning Adjustment for any signage.

 

14. That the developer contribute $1,264.18 in lieu of parkland dedication for 5 single-family units (5 x 3.7 x 0.006 x $11,389.05) in satisfaction of Section 66-128 of the


Subdivision Regulations.

 

15. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

16. That the developer submit covenants, conditions and restrictions for approval by the City for the private open space with the final plat.

 

17. That the 3:1 depth to width ratio per Section 66-124 of the Subdivision Regulation be waived for Lots 1 through 5.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 031066, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
