ORDINANCE NO. 021319

 

Approving an amendment to a previously approved preliminary plan in District CP-1 (Neighborhood Planned Business Center) on approximately a 2.5 acre tract of land generally located at the northwest corner of Sni-A-Bar Road and Blue Ridge Cutoff for the purpose of deleting an approximately .77 acre tract of land from said preliminary plan. (4896-CP-8)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-1 (Neighborhood Planned Business Center) on approximately a 2.5 acre tract of land generally located at the northwest corner of Sni-A-Bar Road and Blue Ridge Cutoff, and more specifically described as follows:

 

All that part of Lot 2, a subdivision of William Lane Estate lying north of Sni-A Bar Road and west of Blue Ridge Cut-Off Road in Jackson County, Missouri, more particularly described as beginning at the northwest corner of Lot 2, subdivision of William Lane Estate, thence east along said north line, 349.0 feet to the westerly right of way line of Blue Ridge Cut-Off Road, said point being 40 feet from the centerline of the concrete pavement measured at right angles to the centerline of said pavement; thence southwesterly on a line parallel to the centerline of said pavement for a distance of 550.70 feet to a point 40 feet north of the centerline of the concrete pavement on Sni-A-Bar Road; thence west 40 feet north of and parallel to centerline of the concrete pavement on said Sni-A-Bar Road, 132.80 feet to the west line of said Lot 2; thence north 517.70 feet to the point of beginning, subject to the right of way of Byrams Ford Road on the west side of the above-described tract of land. Except that portion taken for highway, shown as excepted on the plat.

 

for the purpose of deleting therefrom an approximately .77 acre tract of land, more specifically described as follows:

 

TRACT 1: All that part of Lot 2, Subdivision of William Lane Estate, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Commencing at the intersection of the northerly right of way line of Sni-A-Bar Road Cutoff, as established by the deed filed February 9, 1932 as Document No. 305282, recorded in Book 572, page 498, in the office of the Recorder of Deeds for Jackson County, Missouri, and the west line of said Lot 2; thence due north along the west line of said Lot 2, a distance of 221.29 feet; thence due east, a distance 222.17 feet, to a point on the westerly right of way line of Blue Ridge Cutoff, as established by deed filed March 10, 1932, as Document No. 306301, recorded in Book 571, page 618, in said Recorders Office; thence South 23E12'20" West, 173.47 feet, to a point 40 feet opposite centerline Station 102+33, of said Blue Ridge Cutoff; thence South 55E07'39" West, along the northwesterly right of way of said Blue Ridge Cutoff, a distance of 101.85 feet, to the intersection of said northwesterly right of way line, and the aforesaid northerly line of Sni-A-Bar Cutoff; thence South 87E03'00" West, along last said northerly right of way line, a distance of 70.35 feet to the point of beginning.


Except that part thereof in Byrams Ford Road.

 

TRACT 2: All that part of Lot 2, William Lane Estate, a subdivision in Kansas City, Missouri; beginning at a point 221.29 feet north of a point on the west line of Lot 4, Sni-A-Bar Cutoff, thence North 0E East, 20 feet; thence North 90E East, 75 feet; thence South 82E15'00" East, 148.52 feet; thence North 90E West, 222.17 feet to the point of beginning. Except that part thereof in Byrams Ford Road.

 

so that the remaining tract of land of approximately 1.7 acres, more specifically described as follows:

 

All that portion of Lot 2, the subdivision of William Lane Estate, an addition in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point due north of the intersection of the west line of said Lot 2 and the northerly right of way line of Sni-A-Bar Cutoff as set forth by Document No. 305282 recorded in Book 572, page 498, filed on February 9, 1932, at the Jackson County Recorder of Deeds Office, a distance of 241.29 feet; thence North 90E East, a distance of 75.00 feet; thence South 82E15'00" East, a distance of 148.52 feet to the westerly right of way line of Blue Ridge Cutoff as set forth by Document No. 306301 recorded in Book 571, page 618, filed on March 10, 1932, in the Jackson County Recorder of Deeds Office; thence North 23E12'20" East along said west right of way 318.10 feet to the north line of said Lot 2; thence North 89E21'34" West along said north line 347.54 feet (349.00 feet deed) to the west line of said Lot 2; thence due south along said west line 276.41 feet to the point of beginning. Except that part in Byrams Ford Road as now established.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations, at the time of development of Phase 2.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre, including providing security equal to the estimated cost to install and maintain the approved erosion and sediment control measures for the duration of the land disturbance permit.

 

5. That the developer extend sanitary and/or storm sewers and determine adequacy as required by the Department of Public Works.

 

6. That the developer dedicate additional right of way for Blue Ridge Cutoff along the entire frontage as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of Blue Ridge Cutoff at the time of development of Phase 2.

 

7. That the developer construct sidewalks along the west side of Blue Ridge Cutoff along the entire plan frontage as required by the Department of Public Works at the time of development of Phase 2.

 

8. That the developer improve the east half of Byrams Ford Road along the entire plan frontage to residential street standards as required by the Department of Public Works, including construction of sidewalks at the time of development of Phase 2.

 

9. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, required screening, signage (including elevations), lighting (including a photometric study) and building elevations.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 021319, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
