ORDINANCE NO. 030016

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0457, rezoning an area of approximately 37.23 acres generally located on the west side of Lees Summit Road, approximately 700 feet south of U.S. 40 Highway from Districts R-4 (Low Apartments) and R-4-p (Low Apartments - Limited District) to District R-4 (Low Apartments). BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0457, rezoning an area of approximately 37.23 acres generally located on the west side of Lees Summit Road, approximately 700 feet south of U.S. 40 Highway from Districts R-4 (Low Apartments) and R-4-p (Low Apartments - Limited District) to District R-4 (Low Apartments), said section to read as follows:

 

Section 80-11A0457. That an area legally described as:

 

TRACT I: All that part of the East Half of the Southeast Quarter of Section 25, Township 49, Range 32, Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the northeast corner of the Southeast Quarter of said Section 25; thence along the east line of said Quarter Section, South 01E51'27" West, 781.57 feet; thence North 88E08'33" West at a right angle to the east line of said 1/4 Section, 46.83 feet to the southeast corner of Lot 1, Milton Acres Commercial District, Second Plat, said point being on the west right of way line of Lees Summit Road, and the point of beginning; thence along the west line of said right of way South 03E51'36" West, 269.27 feet; continuing along said right of way South 01E50'33" West, 147.47 feet; thence North 87E04'11" East, 605.88 feet; thence South 01E51'37" West, 1460.54 feet; thence North 87E01'37" West, 688.89 feet; thence North 87E57'08" East, 2127.03 feet; thence South 87E07'53" East, 165.07 feet; thence South 01E58'25" West, 252.04 feet; thence South 87E03'17" East, 1099.89 feet to the point of beginning, containing 36.232 acres, more or less.

 

TRACT II: All that part of the East Half of the Southeast Quarter of Section 25, Township 49, Range 32, Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the northeast corner of the Southeast Quarter of said Section 25; thence along the east line of said Quarter Section, South 01E51'27" West, 781.57 feet; thence North 88E08'33" West at a right angle to the east line of said 1/4 Section, 46.83 feet to the southeast corner of Lot 1, Milton Acres Commercial District, Second Plat, said point being on the west right of way line of Lees Summit Road; thence North 87E03'17" West, 1039.89 feet to the point of beginning; thence South 87E03'17" East, 60.00 feet; thence North 01E58'25" East, 725.01 feet; thence South 87E08'50" East, 60.00 feet; thence South 01E58'25"


West, 725.11 feet to the point of beginning, containing 0.999 acres, more or less.

 

is hereby rezoned from Districts R-4 (Low Apartments) and R-4-p (Low Apartments - Limited District) to District R-4 (Low Apartments), all as shown outlined on a map marked Section 80-11A0457, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
