ORDINANCE NO. 951441

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2617, rezoning an area generally located at the southeast corner of 67th Street and Troost Avenue from District R-2b (Two-Family Dwellings) to District R-5-p (High Apartments - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2617, rezoning an area generally located at the southeast corner of 67th Street and Troost Avenue from District R-2b (Two-Family Dwellings) to District R-5-p (High Apartments - Limited District), said section to read as follows:

 

Section 65.010A2617. That an area legally described as:

 

A tract of land located in the East Half of Section 9, Township 48 North, Range 33 West, in the City of Kansas City, Missouri; said tract is a part of the existing Forest Hill/Calvary Cemetery and more fully described as follows: Commencing at the southwest corner of Section 9, Township 48 North, Range 33 West, thence North 000'36" West along the west line of Section 9 a distance of 1186 feet, thence South 8913'24" East a distance of 40 feet to the point of beginning of the tract. Thence North 000'36" West a distance of 500 feet, thence South 8907'34" East a distance of 625 feet, thence South 000'36" East a distance of 500 feet, thence North 8913'24" West a distance of 625 feet to the point of beginning. Containing an area of 312,500 square feet or 7.17 acres.

 

is hereby rezoned from District R-2b (Two-Family Dwellings) to District R-5-p (High Apartments - Limited District), all as shown outlined on a map marked Section 65.010A2617, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer provide fire protection as required by the Fire Department.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 951441, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
