ORDINANCE NO. 160338

 

Rezoning an area of approximately 0.74 acres generally located on the east side of Topping Avenue, about 650 feet south of Leeds Trafficway from District R-6 to District M1-5. (14656-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1052, rezoning an approximately 0.74 acres generally located on the east side of Topping Avenue, about 650 feet south of Leeds Trafficway from District R-6 (Residential 6) to District M1-5 (Manufacturing 1 (dash 5)), said section to read as follows:

 

Section 88-20A1052. That an area legally described as:

 

All that part of the Northeast Quarter of Section 23 and all that part of the Northwest Quarter of Section 24, all in Township 49 North, range 33 West, in the City of Kansas City, Jackson County, Missouri, more particularly described as follows: beginning at the southeast corner of the Northeast Quarter of said Section 23, thence North 87 degrees 43 minutes 29 seconds West, with the south line of the Northeast Quarter of said Section 23, a distance of 150.00 feet to the southwest corner of Lot 2, as shown on Certificate of Survey filed as Document No. K-1185084 in Book S-5 at page 14, in the Recorder of Deeds Office of Jackson County, Missouri; thence North 02 degrees 09 minutes 59 seconds East, with the west line of said Lot 2, a distance of 40.00 feet to a point on the north line of vacated 39th Street as described in Vacation Ordinance No. 21742; thence South 87 degrees 43 minutes 29 seconds East, with the north line of said vacated 39th Street, and its easterly prolongation, a distance of 150.00 feet to a point on the west line of the Northwest Quarter of Section 24; thence South 87 degrees 42 minutes 32 seconds East, with the north line of vacated 39th Street as described in Vacation Ordinance No. 950567, and its westerly prolongation, a distance of 656.13 feet; thence South 02 degrees 09 minutes 59 seconds West, a distance of 40.00 feet to a point on the south line of the Northwest Quarter of said Section 24; thence North 87 degrees 42 minutes 32 seconds West, with the south line of the Northwest Quarter of said Section 24, a distance of 656.13 feet. The above described tract contains 32,245 square feet, or 0.74 acres.

 

is hereby rezoned from District R-6 (Residential 6) to District M1-5 (Manufacturing 1 (dash 5)), all as shown outlined on a map marked Section 88-20A1052, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
