Approving an amendment to a previously approved
preliminary plan in District CP-2 (Local Planned Business Center) on an
approximately 23.76 acre tract of land generally located at the southwest
corner of N.E. Vivion Road and N.E. Chouteau Trafficway for the purpose of
deleting an approximately 6 acre tract of land from said preliminary plan.

BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved preliminary plan in District CP-2 (Local Planned Business
Center) on an approximately 23.76 acre tract of land generally located at the
southwest corner of N.E. Vivion Road and N.E. Chouteau Trafficway, and more
specifically described as follows:
That an area beginning
at the point of intersection of the centerline of Antioch Road and the
centerline of 50th Street north; thence easterly along the centerline of 50th
Street north to its point of intersection with a straight line which lies
generally north and south and intersects the southwest corner of Lot 30,
Beulmar Acres, a subdivision in Kansas City, Clay County, Missouri, and
intersects with the north line of said Lot 30 at a point which lies 15.40 feet
east of the northwest corner of said Lot 30; thence northerly along said
generally north and south straight line to its point of intersection with a
straight line which lies generally northwesterly and southeasterly and
intersects the east line of Lot 55 in said Beulmar Acres at a point 50 feet
southwest of the northeast corner of said Lot 55 and intersects the west line
of said Lot 55 at a point 55 feet southwest of the northwest corner of said Lot
55; thence northwesterly along said line which lies generally northwesterly to
southeasterly to its point of intersection with the centerline of Antioch Road;
thence southerly along the centerline of Antioch Road to the point of
beginning, and that an area beginning at the point of intersection of the centerline
of Vivion Road and the northwesterly prolongation of the northeast line of Lot
54, Beulmar Acres, a subdivision in Kansas City, Clay County, Missouri; thence
northeasterly along the centerline of Vivion Road to its point of intersection
with the centerline of Chouteau Trafficway; thence southeasterly along the
centerline of Chouteau Trafficway to its point of intersection with the
northerly prolongation of the east line of Lot 43 in said Beulmar Acres; thence
southerly along said northerly prolongation of/and the east line of Lot 43 and
along the east line of Lots 44, 45, 46, all in said Beulmar Acres and the
southerly prolongation thereof to the centerline of 50th Street north; thence
westerly and southwesterly along the centerline of 50th Street north to its
intersection with a straight line which lies generally north and south and
intersects the southwest corner of Lot 30 in said Beulmar Acres and intersects
the north line of said Lot 30 at a point which lies 15.40 feet east of the
northwest corner of said Lot 30; thence generally northerly along said
north-south straight line to its intersection with a straight line which lies

55, a distance of 55.00 feet to the point of beginning of the tract of land to
be described; thence South 5402'45" East, a distance of 215.11 feet to
the centerline of vacated Russell Avenue; thence North 1344'19" East on
said centerline, a distance of 32.10 feet to an angle point therein; thence
North 4969'20" East continuing on said centerline, a distance of 108.33
feet to an intersection with the northerly prolongation of a line drawn from
the southwest corner of said Lot 30 to a point on the northerly line of said
Lot 30, which is 15.40 feet east of the northwest corner thereof; thence South

Section B. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
