ORDINANCE NO. 180448

Approving the preliminary plat of Carruaje Antes De Caballo on about 41 acres in District R-80 generally located on the south side of N.E. 120th Street, approximately 1/4 mile west of N. Stark Avenue, creating 4 single family residential lots. (SD 1581)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section A. The preliminary plat of Carruaje Antes De Caballo on about 41 acres in District R-80 (Residential dash 80) generally located on the south side of N.E. 120th Street, approximately 1/4 mile west of N. Stark Avenue, and more specifically described as follows:

All that part of the West One-Half of the Northeast Quarter of Section 22, Township 52, Range 32, Kansas City, Clay County, Missouri, as described as follows: Beginning at the Northwest corner of the Northeast Quarter of said Section 22; thence South 88 degrees 40 minutes 08 seconds East along the north line of the Northwest Quarter of the Northeast Quarter of said Section 22, a distance of 1325.35 feet to the Northeast corner of the Northwest Quarter of the Northeast Quarter of said Section 22; thence North 88 degrees 46 minutes 13 seconds West, a distance of 00 degrees, 10 minutes, 05 seconds East along said line, a distance of 1348.85 feet, to the Point of Beginning. Said tract containing 40.92 acres, more or less.

is hereby approved, subject to the following conditions:

1.               The developer shall cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri.

 

2.               The developer shall submit a macro storm drainage study with the plat or a letter, from a Missouri-licensed civil engineer to the Land Development Division showing compliance with current adopted standards in effect at the time of submission, including water quality BMP’s, to the Land Development Division for review and acceptance for the entire development area. The developer shall secure permits to construct any improvements as necessary to mitigate impacts from rate, volume, and quality of runoff, prior to recording the plat or prior to issuance of a building permit, whichever occurs first, as required by the Land Development Division.

 

3.               The developer shall dedicate right-of-way for N.E. 120th Street as required by the adopted Chapter 88 so as to provide a minimum of 30 feet of right-of-way as measured from the centerline, and ensure right-of-way dedication is adequate for any proposed road improvements as required by the Public Works Department adjacent to this project.

 

4.               The developer shall subordinate to the City all private interest in the area of any right-of-way dedication, in accordance with Chapter 88 and as required by the Land Development Division, and the owner/developer shall be responsible for all costs associated with subordination activities now and in the future.

 

5.               After the City Plan Commission enters its disposition for the development plan, the developer shall not enter into any agreement that would encumber or otherwise have any impact on the proposed right-of-way dedications for the planned project without the prior written consent of the Land Development Division.

 

6.               The developer shall pay impact fees as required by Chapter 39 of the City’s Code of Ordinances, as required by the Land Development Division.

7.               The owner/developer shall submit plans for grading, siltation, and erosion control to the Land Development Division for review and acceptance and secure a site disturbance permit for any proposed disturbance area equal to one acre or more prior to beginning any construction activities.

 

8.               The developer need not extend the public sanitary sewer system provided the developer demonstrates the proposed private sewage disposal system complies with Chapter 18, Kansas City Building Code, in the City’s Code of Ordinances, and MDNR requirements, prior to recording the Final Plat.

 

9.               The developer shall extend water mains and provide easements by extending a 4” (four inch) water main across the property frontage along N.E. 120th Street.

 

10.           The developer shall provide for fire protection as required by the Fire Department.

 

11.           The developer shall either dedicate parkland or contribute money in lieu of parkland dedication in satisfaction of Section 88-408 of the Zoning and Development Code per the 2018 parkland fees based on the number of units and the following formula:

 

4 single-family lots x 3.7 x 0.006 = 0.089 acres

0.089 acres x $39,617.49 (2018 parkland fee) = $3,525.96

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
