ORDINANCE NO. 971596

 

Approving an amendment to a previously approved Community Unit Project on an approximately 151.1 acre tract of land generally located on the south side of Red Bridge Road and on both sides of Walrond Avenue. (6361-CUP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project on an approximately 151.1 acre tract of land generally located on the south side of Red Bridge Road, on both sides of Walrond Avenue, and more specifically described as follows:

 

TRACT 1: All that part of the Southwest Quarter of Section 3, Township 47, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point on the north line of said Quarter Section North 89 29'8" West, a distance of 965.04 feet from the northeast corner of a tract of land platted as Calico Farm, a subdivision, as recorded in Plat Book B-32 at page 55; thence south and southerly along the westerly line of said plat of Calico Farm the following bearings and distances: South 275 feet; thence South 8 54'29" East, a distance of 277.69 feet; thence South 12 40'26" West, a distance of 214.21 feet; thence South 45 East, 8.48 feet; thence South 35 46'13" West, 187.56 feet to the south line of Calico Drive and the southwest corner of said plat of Calico Farm; thence North 54 35'2" West, 4.18 feet, more or less, along the northeasterly line of Lot 3, Block 6, Calico Farm, Third Plat, a subdivision in Kansas City, Jackson County, Missouri; to the northerly corner of said Lot 3; thence southwesterly, southeasterly and easterly, along the most westerly and southerly lines of the tract of land platted as said Calico Farm, Third Plat, as recorded in Plat Book B-33 at page 15 the following bearing and distances: South 35 24'58" West, 100 feet; thence South 25 35'44" East, 97.34 feet; thence South 89 17'00" East, 120 feet; thence South 20 38'27" East, 107.74 feet; thence South 40 43'59" East, 56.76 feet; thence South 22 7'00" East, 104 feet; thence South 1 44'00" East, 232 feet; thence South 74 19'22" East, 116.75 feet to the westerly line of Calico Drive; thence southwesterly along the westerly line, 307.98 feet; thence South 36 44'16" East, 61.46 feet; thence South 48 44'56" East, 293.24 feet; thence East 630 feet to a point in the east line of said Southwest Quarter being the southeast corner of said Calico Farm, Third Plat, and 2120 feet south of the northeast corner of said Quarter Section; thence south along said east line to the southeast corner of said Quarter Section; thence west along the south line of said Southwest Quarter to a point 100 feet east of the west line thereof; thence North 100 feet east of and parallel to the west line of said Quarter Section to the north line thereof; thence east along said north line to the point of beginning, subject to that part thereof in Red Bridge Road, and to that part thereof in Calico Drive. The basis of bearings for the above described tract are as on the recorded plat of Calico Farm.

 

TRACT 2: Lot 12, Block 2, Calico Farm, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT 3: Lots 2 and 3, Block 6, Calico Farm, Third Plat, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof. The bearings in these excepted tracts are based on the Missouri Coordinate System Equation: Due south on said plats equals South 3 26'55" West, on Missouri Coordinate System.

 

TRACT 4: Calico Farm, Calico Farm 2nd Plat and Calico Farm Third Plat, subdivisions in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first final plat is submitted and that the

developer make any improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for Red Bridge Road as required by the Department of Public Works so as to provide a total of 50 feet of right of way

as measured from the centerline of Red Bridge Road.

 

6. That the developer improve the south half of Red Bridge Road to primary arterial street standards as required by the Department of Public Works, including

construction of curb, gutter, and sidewalks and installation of streetlights.

 

7. That the developer construct all interior streets to City residential street standards as required by the Department of Public Works, including construction of curb, gutter

and sidewalks on at least one side and installation of streetlights.

 

8. That the developer contribute $65,086.66 in lieu of parkland dedication for 376 multi-family units and 70 single family units in satisfaction of Section 66-128 of the

Subdivision Regulations.

 

9. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer extend sanitary sewers as required by the Department of Public Works.

 

12. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

13. That the developer submit a final plan for each phase to the City Plan Commission for approval, including landscaping and building elevations.

 

a copy of said Community Unit Project plan amendment is on file in the office of the City Clerk under Document No. 971596, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
