COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 980611

 

Approving real property tax abatement for improvements on property generally located at the northwest corner of Winchester Avenue and 65th Street Terrace within the Enterprise Zone and directing the City Clerk to provide a copy of this ordinance to the State Director of Economic Development.

 

WHEREAS, Section 135.215, RSMo, authorizes tax abatement within an Enterprise Zone for certain specified industrial-related uses and for other uses if approved by the governing body and if at least fifty new employees on average of at least 35 hours a week are created; and

 

WHEREAS, Golub-Wegco Kansas City I, L.L.C., has requested tax abatement for proposed improvements to real property at at its proposed facility generally located at the northwest corner of Winchester Avenue and 65th Street Terrace; and

 

WHEREAS, the application of Golub-Wegco Kansas City I, L.L.C., proposes to create more than fifty new jobs and to comply with the requirements of Section 135.215, RSMo, and Committee Substitute for Ordinance No. 971342, specifically Section 5; and

 

WHEREAS, upon issuance of a Certificate of Occupancy for the new building, the Director of the Department of City Development will investigate and determine whether the application complies with Section 135.215, RSMo, and Committee Substitute for Ordinance No. 971342, specifically Section 5; and

WHEREAS, pursuant to the provisions of Section 135.215(2), RSMo, all public notices have been given and public hearing held on the issue of tax abatement; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Pursuant to Section 135.215, RSMo, the City Council hereby approves the application for tax abatement by Golub-Wegco Kansas City I, L.L.C., for the property located in the Enterprise Zone in Winchester Office Center West at the northwest corner of Winchester Avenue and 65th Street Terrace, legally described as:

 

All of Tract 3, together with that part of Tract 4, Winchester Office Center West, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, being more particularly described as follows: Beginning at the most southerly corner of said Tract 4, being also a point on the northeasterly right of way line of Beacon Drive, as now established; thence the following courses and distances along the southwesterly line of said Tract 4 and along said northeasterly right of way line; thence North 4310'00" West, 49.78 feet; thence northwesterly along a curve to the left, tangent to the last described course, having a radius of 2,030 feet and a central angle of 429'08", an arc distance of 158.93 feet; thence North 4739'08" West, tangent to the last described curve, a distance of 244.32 feet; thence North 4220'52" East, perpendicular to the last described course and no longer along the


southwesterly line of said Tract 4, a distance of 395 feet; thence North 2931'10" East, 386.91 feet to an angle point in the northeasterly line of said Tract 4; thence South 4311'15" East along said northeasterly line, a distance of 164.04 feet to the northeast corner thereof, being also the northwest corner of said Tract 3; thence the following courses and distances along the northerly line of said Tract 3: thence North 6929'00" East, 94.89 feet; thence North 1314'00" East, 145 feet; thence South 7227'00" East, 406.50 feet; thence South 2358'00" East, a distance of 312.30 feet to a point on the easterly line of said Tract 3; thence the following courses and distances along the easterly line of said Tract 3: thence South 222'06" West, 399.78 feet; thence South 3251'00" East, 311.97 feet; thence South 2021'00" West, 373.42 feet to the southeast corner of said Tract 3, being also a point on the north right of way line of said Beacon Drive; thence the following courses and distances along the southerly line of said Tract 3 and 4 and along the north right of way line of said Beacon Drive; thence North 6540'00" West, 90.88 feet; thence northwesterly along a curve to the left, tangent to the last described course, having a radius of 905 feet and a central angle of 1020'00", an arc distance of 163.22 feet; thence North 7600'00" West, tangent to the last described curve, a distance of 313.97 feet; thence northwesterly along a curve to the right, tangent to the last described course, having a radius of 540 feet and a central angle of 3250'00", an arc distance of 309.45 feet; thence North 4310'00" West, tangent to the last described curve, a distance of 140.22 feet to the point of beginning.

 

Section 2. The tax abatement granted herein shall be 50% of the value of the improvements for a period of 10 years and shall apply to the following:

 

Jackson County - Handicap WSP

Metropolitan Junior College

Mid Continent Library

Raytown School District

Jackson County

Kansas City

 

provided that the Director of the Department of City Development certifies that the application complies with Section 135.215, RSMo, and Committee Substitute for Ordinance No. 971342, specifically Section 5(b). The tax abatement granted herein shall not begin until the Director of the Department of City Development has determined and certified that the application meets the requirements of Section 135.215, RSMo, and Committee Substitute for Ordinance No. 971342, specifically Section 5(b).

 

Section 3. That the City Clerk is hereby directed to deliver a copy of this ordinance to the State Director of Economic Development within thirty calendar days following passage of this ordinance.
