ORDINANCE NO. 900838

Approving the plat of Oak Barry Center 2nd Plat, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways; authorizing the Director of Public Works to execute certain agreements, and authorizing the City Clerk to file this ordinance and attached agreement.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the plat of Oak Barry Center 2nd Plat, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City directrix.

Section 4. That all right, title and interest in sewer easements recorded under Document Numbers G24069, G24070, D1117 and D10408 and storm drainage easements recorded under Document Numbers G43798, G51069, G43797 and G51070 be and the same are hereby released to the respective owner, their successors or assigns.

Document Number G24069 A strip of land 10.00 feet in width, over and across part of the Northeast quarter of Section 11, Township 51, Range 33, Kansas City, Clay County, Missouri, lying 5.00 feet on either side of the following described Centerline: Commencing at the Southwest corner of said Northeast quarter; thence South 89 degrees 45 minutes 58 seconds East, along the south line of said Northeast quarter, 436.55 feet; thence North 0 degrees 14 minutes 02 seconds East, 993.95 feet to the True Point of Beginning of the Centerline to be herein described; thence North 46 degrees 27 minutes 8 seconds East, 249.62 feet to a point in the Centerline of an existing sanitary sewer easement, said point being the Point of Termination.

Document Number G24070 A strip of land 10.00 feet in width, over and across part of the Northeast quarter of Section 11, Township 51, Range 33, Kansas City, Clay County, Missouri, lying 5.00 feet on either side of the following described Centerline: Commencing at the Southwest corner of said Northeast quarter; thence South 89 degrees 45 minutes 58 seconds East, along the South line of said Northeast quarter, 460.29 feet; thence North 0 degrees 14 minutes 02 seconds East, 499.50 feet to the True Point of Beginning of the Centerline to be herein described; thence North 12 degrees 59 minutes 29 seconds West, 234.16 feet; thence North 5 degrees 36 minutes 26 seconds East, 262.64 feet; thence North 46 degrees 27 minutes 08 seconds East, 7.25 feet to the Point of Termination.

Document Number D1117 All that part of a strip of land 10.0 feet wide lying within 5.0 feet on each side of the following described centerline which lies within the following described tract of land:

Said tract beginning at a point on the East line of the Southwest Quarter of the Northeast Quarter of Section 11, Township 51 North, Range 33 West, in Kansas City, Clay County, Missouri, 993.96 feet North of the Southeast Corner thereof; thence North 354.0 feet; thence West 924.57 feet; thence South 334 feet; thence West to the West line of said Quarter Quarter Section; thence South 20 feet; thence East to the point of beginning. Excepting that part in North Oak Street Trafficway.

Said centerline beginning at a point on the southerly line of said tract, 114.9 feet westerly of the southeasterly corner thereof; thence northwesterly along a straight line, which makes a northwesterly angle of 28 degrees 20 minutes 02 seconds with the southerly line of said tract, 202.0 feet; thence northwesterly along a straight line which deflects 16 degrees 29 minutes 00 seconds left from the last described centerline 266.3 feet; thence northwesterly along a straight line which deflects 3 degrees 52 minutes 00 seconds left from the last described centerline 150.0 feet; thence northwesterly along a straight line to a point on the most northerly line of said tract, 98.2 feet easterly of the most northerly-northwesterly corner thereof. Said centerline beginning at a point on the easterly line of said tract 5.0 feet northerly of the southeasterly corner; thence along a line parallel and 5.0 feet northerly of the southerly line of said tract 124.1 feet; thence along a straight line which deflects 28 degrees 20 minutes 02 seconds to the right from the last described course 190.8 feet; thence along a straight line which deflects 16 degrees 29 minutes 00 seconds to the left from the last described course 266.3 feet; thence along a straight line which deflects 3 degrees 52 minutes 00 seconds to the left from the last described course 150.0 feet; thence northwesterly along a straight line to a point on the most northerly line of said tract 98.2 feet easterly of the most northerly-northwesterly corner.

Section 5. That the Director of Public Works is hereby authorized to execute a covenant to maintain storm water detention facilities, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference.

Section 6. That the City Clerk is hereby directed to file copies of this ordinance, together with the covenant to maintain storm water detention facilities, attached hereto, and in the Office of the Recorder of Deeds of Clay County, Missouri together with all other relevant documents.

Section 7. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
