Approving the preliminary plat of
Lidias Freight House, a Condominium Plat, on about 4.42 acres generally
located west of Main Street and south of W. 22nd Street. (SD 1386A)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Lidias Freight House, a Condominium Plat, on about
4.42 acres generally located west of Main Street and south of W. 22nd Street, and more specifically described as follows:
A tract of land located in the Northwest Quarter of Section
8, Township 49, Range 33, in Kansas City, Jackson County, Missouri, being more
particularly described as follows: Beginning at a point on the South
right-of-way line of 22nd Street at the extension of the West right-of-way line
of Wyandotte Street; thence North 612027 East (North 58 degrees 08 minutes
29 seconds East deed) along said South right-of-way line, a distance of
491.17 feet (491.03 feet deed) to a point on the East right-of-way line of
Baltimore Avenue; thence North 023326 East (North 00 degrees 38 minutes 42
seconds West deed) along said East right-of-way line a distance of 11.69 feet
(measured and deed); thence North 612027 East (North 58 degrees 08 minutes
29 seconds East deed) a distance of 280.47 feet (280.58 feet deed) to a
point on the West right-of-way line of Main Street Viaduct; thence South
031419 West (South 00 degrees 01 minutes 41 seconds West deed) along said
West right-of-way line a distance of 378.21 feet (379.72 feet deed) to a
point on the Northerly line of a tract of land owned by Kansas City Terminal
Railway Company; thence South 715923 West (South 68 degrees 42 minutes 58
seconds West deed) along said Northerly right-of-way line a distance of
700.34 (700.46 feet deed) to a point on the extension of the West
right-of-way line of Wyandotte Street; thence along said Extension Line North
023753 East (North 00 degrees 37 minutes 48 seconds West deed) a distance
of 212.61 feet (215.03 feet deed) to the point of beginning, except that part
in streets and roads, and containing 192,476 square feet or 4.42 acres, more or
less.
is hereby approved, subject to
the following conditions:
1. That the developer cause the area to be platted and processed
in accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2. That the developer submit a letter from a licensed civil engineer,
licensed architect, or licensed landscape architect, who is registered in the
State of Missouri, stating the condition of the sidewalks, curbs, and gutters.
The letter must identify state of repair as defined in Chapters 56 and 64, Code
of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the
quantity and location of sidewalks, curbs, and gutters that need to be
constructed, repaired, or reconstructed. The developer shall secure permits to
repair or reconstruct the identified sidewalks, curbs, and gutters as necessary
along all development street frontages, as required by Development Services,
prior to recording the plat.
3. That the developer submit covenants, conditions and
restrictions to Development Services for approval by the Law Department for the
maintenance of common elements.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
