ORDINANCE NO. 980925
Approving the First Amendment to the Development
Plan submitted by the 63rd and Troost Redevelopment Corporation generally
located at the northeast corner of 63rd Street and Troost Avenue; declaring the
additional area included in such plan to be a blighted area and its
redevelopment necessary for the preservation of the public peace, prosperity,
health, safety, morals and welfare; authorizing the Director of Finance to
enter into a First Supplemental Contract with the 63rd and Troost Redevelopment
Corporation; and authorizing certain tax abatement for the additional area with
the plan. (Case No. 501-S-1)
WHEREAS, the 63rd and Troost
Redevelopment Corporation, an urban redevelopment corporation of Missouri,
organized under and pursuant to the Urban Redevelopment Corporations Law, as
amended, did on March 3, 1997, file with the City Clerk an application for
approval of a Development Plan, which was approved by the City Council by
Second Committee Substitute for Ordinance No. 971048, passed November 6, 1997;
and
WHEREAS, the 63rd and Troost
Redevelopment Corporation did on May 8, 1998, file with the City Clerk an
application for approval of a First Amendment to the Development Plan; and
WHEREAS, the First Amendment proposes
to add a small additional area directly north and adjacent to the plan area
located on Troost Avenue to the Development Plan; and
WHEREAS, the City Clerk did refer
the First Amendment to the Development Plan to the City Plan Commission; and
WHEREAS, the City Plan Commission
did cause notice to be published in the Daily Record, a newspaper doing the
City's printing on June 22, 1998, such date being not less than ten (10) days
prior to the date set for the hearing; and
WHEREAS, the City Plan Commission
did hold a public hearing on the First Amendment on July 7, 1998, at which time
all interested persons were given an opportunity to be heard; and
WHEREAS, the City Plan Commission
has made an independent study and investigation of the First Amendment and did
recommend approval of the First Amendment to the Development Plan and did
submit a report on the same, a copy of which is attached hereto and
incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section 1. That the application of
the 63rd and Troost Redevelopment Corporation for approval of a First Amendment
to the Development Plan, filed with the City Clerk, and amended in accordance
with recommendations of the City Plan Commission, is hereby incorporated herein
by reference and approved as a First Amendment to the Development Plan as
originally approved by Second Committee Substitute for Ordinance No. 971048,
passed November 6, 1997. A copy of the application is on file in the office of
the City Clerk under Document No. 980925 which is attached hereto and
incorporated herein by reference.
Section 2. That the Council finds
and declares that good cause has been shown for the approval of the First
Amendment to the Development Plan of the 63rd and Troost Redevelopment
Corporation and that the findings and declarations made by the Council in
Sections 2, 4 and 5 of Second Committee Substitute for Ordinance No. 971048,
with respect to the Development Plan of the 63rd and Troost Redevelopment
Corporation, have not been affected by the amendments thereto and equally apply
to said Development Plan, as amended. Further, the Council finds and declares
that the additional area being described in the First Amendment to the
Development Plan submitted by the 63rd and Troost Redevelopment Corporation is
a blighted area as defined by Section 353.020(2), Revised Statutes of Missouri,
and Section 74-4, Code of Ordinances of the City of Kansas City, Missouri, and
the redevelopment thereof is necessary for the public convenience and
necessity; and that the approval of the First Amendment to the Development Plan
and the construction of the redevelopment project are necessary for the
preservation of the public peace, prosperity, health, safety, morals and
welfare.
Section 3. That the Council hereby
finds and determines that the public convenience and necessity will be served
by the Development Plan, as amended.
Section 4. That the Director of Finance
be, and she is hereby, authorized and directed on behalf of the City to enter
into a First Supplemental Contract with the 63rd and Troost Redevelopment
Corporation, a copy of which in substantial form is attached hereto as Exhibit
"B" and which is hereby incorporated herein by reference.
Section 5. That the 63rd and Troost
Redevelopment Corporation is hereby granted tax abatements on land and
improvements for the additional area included in the plan area in the First
Amendment as provided in Exhibit B.
