RESOLUTION NO. 070464

 

Waiving a conflict of interest in regard to the possible legal representation of the City by Dysart Taylor Lay Cotter and McMonigle, P.C.

 

WHEREAS, the City is considering retaining the law firm of Dysart Taylor Lay Cotter and McMonigle, P.C. (Dysart Taylor) to represent the City in the condemnation of certain properties within the boundaries of, and necessary for, the 39th and Prospect TIF Plan (Project 1); and

 

WHEREAS, Dysart Taylor currently represents Missouri Gas Energy in various property damage claims it asserts against the City; and

 

WHEREAS, Section 2-83, Code of Ordinances, requires the Council to consider whether it is in the Citys best interest to waive a conflict of interest; and

 

WHEREAS, it is in the Citys best interest to waive the conflict of interest of Dysart Taylor, provided that Dysart Taylor takes the steps necessary to preserve the Citys attorney-client privilege regarding the legal matters for which the City has retained it; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the Council hereby waives the conflict of interest created by the representation of Missouri Gas Energy and the City by Dysart Taylor, and authorizes the City Attorney to execute a letter waiving the conflict if the City Attorney decides to retain Dysart Taylor provided that Dysart Taylor, in the judgment of the City Attorney, has taken all the steps necessary to preserve the Citys attorney-client privilege regarding the legal matters for which it may be retained by the City.
